Delaware, MoneyGram, Unclaimed Property

This case is a “controversy between two or more States” within the original jurisdiction of the Supreme Court. The dispute is over which State is entitled to escheat, or take custody of the proceeds of certain unclaimed monetary instruments issued by MoneyGram.

The Special Master, Judge Leval, has determined the disputed financial instruments are the type of property addressed in the Federal Disposition Act. Therefore, if unclaimed the official checks are to be escheated to the state where they were originally purchased.
