Let’s start with what is different about practicing criminal law in a tribal court: you will have more freedom to negotiate agreements for your clients, you will become a better trial advocate because there aren’t as many rules and the penalties are not counter-intuitive (often times we take cases to trial because it will improve the sentencing possibilities). Remember, the Colville Tribe is new and evolving.—you will have the ability to affect the law and practice in a way that would never be able to in state courts.
What will be expected of you? You will manage a small law office funded by the Colville Tribes to provide representation in the Colville Tribal Court. Duties will include: supervision of staff which includes 1 attorney, 2 spokespersons, and 2 support staff. Will provide adequate supervision and on-the-job training to ensure each client receives competent & ardent representation in criminal, MINOC, and habeas proceedings both at the trial court and court of appeals levels. Propose a yearly budget. Provides reports to the executive staff of the Tribal Government.
Criminal Law Experience, Indian Law Experience, and Management experience will be given higher preference.
Must be a graduate of an accredited law school and a WSBA Bar Member. You will also have to become a member of the Colville Tribal Bar upon hire.
You will receive a three-year contract, an office space, 401K, and many other benefits.

If you’re arrested, invoke your right to be silent. The police don’t have to give Miranda warning if they’re not asking questions.

The July Celebrations are this weekend. The police are going to be out in full force with an emphasis on you.
Remember to invoke your right to silence. Don’t explain what happened.
Don’t give “permission” to search. If you are asked, just say no.
Don’t carry around illegal substances or devices to use them.
Have a SAFE and HAPPY CELEBRATION. Our traditions include being with our families not in jail.

Memorial Day is an “emphasis” holiday. Keep in mind, in Tribal Court, you will spend at least 3 days in jail before your arraignment. The best course is to have a sober designated driver so that you don’t go to jail.
If you are arrested, invoke your right to remain silent, and call us.

Resisting Arrest. Remember folks, the best course of action is to cooperate, even if you KNOW that you did not do anything wrong. Don’t try to explain yourself or pull away or run. Those kinds of things are likely to get you in more trouble or worse it could get you seriously injured.

It’s Friday! Be safe this weekend.
A little advice for you—if you have been accused of a crime:
You don’t need to “turn yourself in.” The police aren’t really going to say that “he must be innocent,” generally if they think you committed a crime you’re not changing there mind by explaining what “actually happened.” They determined you’re wrong without talking to you and that is the end of it.
I recommend you let them earn their pay check. You wait until they come to you. Cooperation means you don’t run, argue, or fight. It does not mean explaining or answering questions. You invoke your right to remain silent. Don’t say anything about what happened.
Honestly, the police are no different than the Jehovahs knocking at your door-don’t answer and they will go away (unless they have a warrant).

Did you know that when charges are filed against you, it is not because an individual wants this to happen?
As a citizen, you can make a complaint to the police. It is up to the police to investigate that complaint but the only one who decides what cases get filed is the Prosecutor.
This means that, even if you were the victim of an assault, once a complaint has been made and the prosecutor files those charges, you don’t have the ability to have that case dismissed.
Why? Because the government has made a preliminary finding that defendant has violated the law.
In the Colville Tribal Court, the alleged victim has the right to not be compelled to testify (i.e. s/he cannot be subpoenaed and forced to tell a judge or jury) what took place. However, that doesn’t mean the case gets dismissed.
For these reasons, it is best to not use Law Enforcement to act as your referee.
1) If you have an argument allow time to cool off before it turns into threats to harm or a physical altercation.
2) If you have been violent with your partner, get help! You can learn to think about the situations that have resulted in physical violence differently so that no one gets hurt because there is no justification for turning an argument into a fist fight. You don’t have the right to discipline your significant other.
3) If you cannot get along with your spouse, perhaps you need to think about a separation to prevent dragging each other’s names, reputations, or bodies through the mud.
