For Indian applicants, who made up nearly 70% of all H-1B beneficiaries, the odds remain challenging when factoring in over-subscription and duplicate entries flagged in audits.

For international students in the U.S. on F-1 visas, the typical post-graduation route is OPT (Optional Practical Training), which lasts 12 months, or up to 36 months for STEM graduates. But once OPT ends, students must obtain an H-1B visa to remain in the country.

The EB-5 Regional Center Program is authorized through September 30, 2027 but the Grandfathering protection deadline is September 30, 2026. That's a critical distinction most investors miss.

If You File Your I-526E On or Before September 30, 2026:

• Your case continues to be processed even if the EB-5 Regional Center Program lapses after September 30, 2027

• You will not be stuck in a freeze waiting for Congress to reauthorize the Program

• If Congress modifies or eliminates visa set-asides, properly filed petitions remain eligible under current rules

• Concurrent filing will allow you to obtain work authorization and advance parole while awaiting the Green Card

• You lock in the current $800,000 minimum investment, even if future legislation raises it

• Your children's ages can be frozen under the Child Status Protection Act, preventing aging out

If You File After September 30, 2026:

• You are not protected under the Grandfathering provision
