Re: Demand For Removal and Refund of Defect Equipment
Mr. Denneny:
Please consider this letter written demand for the immediate removal of your defective equipment from our St. Peters location and a refund of the full purchase price for each piece of defective equipment.
The equipment you provided is not safe, and it is not of commercial quality. In making our purchase decision, we relied on your representation that this equipment was capable of operating safely and reliably in a shop setting. Indeed if you had not represented that the equipment was safe and capable of operating in a commercial setting, we would not have purchased the equipment.
Over the months, we have tried to work with you to fix the near constant problems with the equipment. To date, you have been unable or unwilling to bring the equipment into a safe and commercially operational state.
In order to ensure the safety of our staff and the operation of our St. Peters facility, we are demanding you make immediate arrangements to remove your defective equipment from the shop.
We are demanding you refund the purchase price of the equipment as follows:

Over the past few months, we have given Autotech many opportunities to make good on its promise to provide safe, working equipment. We are not willing to sacrifice the safety of our staff or the excessive, continued downtime this defective equipment is causing.
Please contact me immediately to make arrangements to remove this equipment and refund the purchase price.
