MARTINSBURG, W. Va. – Berkeley County Prosecuting Attorney Catie Wilkes Delligatti announces that on Tuesday, May 31, 2022, the May 2022 term of Grand Jury was convened at the Berkeley County Judicial Center. Grand Jury deliberations lasted through Friday, June 3rd, 2022. The Berkeley County Prosecutor’s Office announces that the Grand Jury returned a total of 112 indictments.
Indictments were returned against the following individuals for the following counts:
KRYSTAL DAWN ANDERSON, 41, of Martinsburg, West Virginia, was charged with Shoplifting First Offense, Conspiracy to Commit Shoplifting First Offense, Grand Larceny, Conspiracy to Commit Grand Larceny and Fraudulent Use of an Access Device.
COREY LEE BARNETT, 22, of Martinsburg, West Virginia, was charged with Attempted Wanton Endangerment and Conspiracy to Commit Wanton Endangerment with a Firearm.
WENDELL ELIJAH BATES, 35, of Arlington, Virginia, was charged with Distribution of a Synthetic Cathinone, two counts of Distribution of Co***ne Base and Fleeing from a Law Enforcement Officer with Reckless Indifference.
LINDA ANN BENNETT, 63, of Inwood, West Virginia, was charged with fifteen counts of Fraudulent Use of an Access Device.
MATTHEW BLAKE BERNSTEIN, 37, of Berkeley Springs, West Virginia, was charged with Third Offense for Driving Under the Influence of Alcohol, Possession of a Stolen Vehicle and Misdemeanor Person Prohibited from Possession of a Firearm.
DONALD HOWARD BERRY, JR., 31, of Edinsburg, Virginia, was charged with Wanton Endangerment.
LLOYD ANTHONY BLACK, 36, of Martinsburg, West Virginia, was charged with three counts of Wanton Endangerment and Felony Possession of a Firearm.
DAMIAN LANELL B-SMITH, 23, of Martinsburg, West Virginia, was charged with two counts of S*xual Assault in the First Degree, S*xual Abuse in the First Degree and three counts of S*xual Abuse by Person in a Position of Trust.
JEFFREY SCOTT BURKHART, 58, of Hedgesville, West Virginia, was charged with Distribution of Fentanyl and Conspiracy to Distribute Fentanyl.
JACOB DALE BURRELL, 33, of Martinsburg, West Virginia, was charged with S*xual Assault in the Second Degree and S*xual Assault in the Third Degree.
DENNIS D. BUTTS, 46, of Hedgesville, West Virginia, was charged with Distribution of Fentanyl and Conspiracy to Distribute Fentanyl.
CHRISTIAN JAMES CALLAHAN, 22, of Martinsburg, West Virginia, was charged with Conspiracy to Commit Wanton Endangerment with a Firearm.

DUSTIN ALBERT CAREY, 33, of Martinsburg, West Virginia, was charged with two counts of S*xual Abuse in the First Degree, two counts of S*xual Assault in the Second Degree and five counts of Domestic Battery.
BRIAN RUSH CARRIER, 36, of Martinsburg, West Virginia, was charged with four counts of Child Abuse Causing Bodily Injury.
KELLY ANN CARSON, 30, of Martinsburg, West Virginia, was charged with Grand Larceny and Conspiracy to Commit Grand Larceny.

TYSHON JAMES WILSON, 42, of Martinsburg, West Virginia, was charged with Felony Destruction of Property, Possession with Intent to Deliver Ma*****na and Felony Possession of a Firearm.
MATTHEW DAVID WOLLARD, 35, of Martinsburg, West Virginia, was charged with two counts of Indecent Exposure Third Offense.
