Deadline Approaching: MLR Rebates for Employers

Employers with insured group health plans may soon receive medical loss ratio (MLR) rebates from their insurance issuers. Rebates for the 2024 plan year must be distributed by September 30, 2025.

What employers need to know:
✅ Rebates may come as a premium credit or lump-sum payment
✅ Any portion considered a plan asset under ERISA must be used for employees’ benefit
✅ Employers should use rebate funds within three months to avoid ERISA’s trust requirement
✅ Be prepared to answer employee questions about how the rebate is allocated

A new federal law just reshaped employee benefits and most employers aren’t ready.

Signed on July 4, the One Big Beautiful Bill Act (OBBB Act) introduces sweeping changes that will directly affect benefit strategies starting in 2026.
