VOTE NO ON 25!

Written by Sacramento politicians, Prop 25 eliminates the right to post bail for every Californian. Instead of having the option to secure your release through bail or a pretrial release program administered by the counties, Prop 25 requires the use of computer-based profiling based on algorithms to determine who can and can’t get out of jail pending their trials. These computer algorithms, managed by government bureaucrats, replace the role of judges in our current system.

Imagine trying to help a loved one accused of a crime secure their release in order to answer the charges against them – and having their freedom depend on computer algorithms and predictive models that have been shown to be racially biased. Without a judge to set bail or the terms of release, important criminal justice decisions will be at the mercy of the bureaucracy and biased computer formulas.

How does it help a woman with a loved one in jail to refrain from calling to her attention the availability of bail? If you were in such a situation, which would you rather have — the phone numbers of open-all-night storefronts where you could get your son or brother bailed out, or a tidy lecture about how the whole institution of cash bail is unfair and needs to be rethought?

Google also cites its ban on ads for “deceptive or harmful products.” But once a judge has set cash bond in the first place, it’s hard to take seriously a claim that helping families meet that requirement must inevitably involve deceit or harm.

Bail Bondsman Killed

29 year-old James Dangelo Arnold, accused of armed robbery, was out of jail on a bond at the time of the shooting.

After reviewing surveillance video and other evidence, investigators charged Arnold with second-degree murder in the shooting death of 53-year-old bail bondsman Jim Cole.

“John Von Achen, another bail bondsman who was a friend of the victim, said he believes his friend might have been killed while trying to take Arnold into custody after he violated the terms of his bond.”

"You can't trust anybody, he said. It gravely concerns me, and just to think that somebody you've helped out so many times would do this.”

“Von Achen said the shooting was likely recorded by a surveillance camera."

This is a dangerous job and it is important that the community and lawmakers understand the real risks we take. When someone violates the terms of their bond, it is up to us to bring them to court.

How can automatically releasing defendants charged with kidnapping, r**e, child molestation and s*x trafficking into our community with just a promise to appear, be considered progressive? Or good for our community?

'San Francisco Sheriff Vicki Hennessy said defendants charged with crimes as serious as kidnapping and r**e were among the 791 people out of jail on pretrial release on an average day in the first three months of 2018 — 284 more a day on average than in the first quarter of 2017. And those numbers only account for defendants facing felonies.

LOBBYING EFFORTS FOR THE CALIFORNIA BAIL INDUSTRY
The Golden State Bail Agents Association is representing the bail industry in Sacramento. For more than 10 years, GSBAA has served the bail industry through it tireless work in public affairs and education. Here is a list of legislation that GSBAA successfully opposed on behalf of the bail industry:

SB 1744 Which would have eliminated your right to apply for extensions of the 180-day forfeiture period
SB 210 A bill designed to increased OR release
AB 1082 Bail agents would be held responsible for attorney’s fees on appeal motions
AB 1406 The $30.00 per bond fee legislation to fund prosecution of bail agents/agencies
AB 2166 Bail forfeiture litigation to restrict the bail industry’s due process rights on appeal
SB 1265 Language that would have allowed an LLC to operate a bail agency without having to obtain a bail agent license
AB 2385 Probation language that would have released pre-trial defendants through electronic monitoring without having to post bail
SB 1180 Evidence based pre-trail risk assessment language to increase OR release

GSBAA has also been successful in getting AB 404 passed which allows online continuing education classes and AB 805 amending the realignment law to allow the could to use risk assessment reports in setting, reducing or denying bail and bills to make extradition easier.
