Prop 25 is a veto referendum to stop SB10 (“bail reform”) from becoming law. Want to know how “bail reform” works? Look no further than New York where it was already tried and failed. In fact, it only lasted 4 months after enactment (Jan thru Apr of 2020) before Governor Cuomo and Mayor Bill de Blasio — previous advocates of bail reform — had to REVERSE themselves and push a new bill to stop the damage. Only three weeks after New York's bail reform was enacted, CNBC said, “In what’s becoming an almost hourly stream of depressing updates, New York’s newspapers, local TV news shows, and news sites are posting story after story about violent crimes being committed by people instantly released after arrests because of bail reform. We've had an experiment with "zero bail" in California during the COVID pandemic. We saw similar bad results — suspects get arrested for a crime, are released within hours, and go on to commit the same crime again.
We don’t think the “risk assessment” algorithm described in SB10 makes California’s effort at bail reform any better. At its core, it is the END to cash bail that will have negative consequences.
TPOA says the concept of addressing financial inequities in the criminal justice system is a valid concern. But PROP 25 is not the answer. Prop. 25 will make "zero bail" permanent, which is why law enforcement throughout the state oppose it.
