The Department of Homeland Security has published a comprehensive proposed rule to implement the EB-5 Reform and Integrity Act of 2022 (RIA). More than four years after the RIA became law on March 15, 2022, USCIS is now proposing to codify the RIA's statutory requirements into 8 CFR Parts 204, 205, 216, and 235.

This is one of the most consequential proposed rules for EB-5 practice since the RIA itself. It creates an entirely new regulatory subpart D dedicated to EB-5, establishes a comprehensive enforcement framework, formalizes priority date retention, implements redeployment parameters, requires promoter registration, and eliminates several longstanding practices including bridge financing as a basis for job creation and the troubled business pathway.
