Hall Insurance opened in August of 2012 with a goal to be different than most would typically expect from an insurance agency. In Tennessee, workers’ compensation requirements vary based on the type of business you have combined with your total number of annual employees.

If you hire a W-2 employee, yet the state does not require you to carry Work comp, this does not mean that you are not liable for an injury they sustain while they are working for you. If you hire a 1099 independent contractor and do not require proof insurance, you may be held responsible for their medical expenses if they are injured on the job.

Additionally, family members, including children, who work for your business may still count toward the state’s definition of employees and should be properly covered.

The bottom line: just because state workers’ compensation laws may may require you to carry workers compensation for your business doesn’t mean you’re not exposed to the liability of paying for an injured worker.
