Your settlement can set a refinance deadline. Your lender decides whether you meet it.

Approval depends on your income on its own, your credit, and your debt-to-income once the buyout is added to the loan. If any of those fall short on day one, the deadline becomes a second negotiation after the decree is final.

Ask a lender to test the numbers before the clause goes in.

Save this before your mediation.

A HELOC can look like the easy way to buy out your ex. Borrow against the house, pay the buyout, keep the home.

A HELOC is a second loan. It doesn't change the first mortgage, so if both names are on that loan today, both names stay on it. Only a refinance, an assumption, or a release from the lender takes a name off.

It also has to work on your income alone. Some lenders figure the payment on the full credit line, not just what you draw, and most HELOC rates are variable, so the cost can change after you close.

Before a HELOC buyout goes into your settlement, ask:
1. Who stays on the first mortgage?
2. How will this lender figure the HELOC payment?
3. Do I qualify on my income with both loans?

Save this before your mediation.

Picture a 58-year-old homeowner, married 29 years, kids grown. The house is most of what they built together.

Keeping it means buying out her ex. The money has to come from somewhere, and the retirement account is the easy answer on paper.

Same question a 40-year-old asks: can I keep the house? The difference is time. At 58 there are fewer years to rebuild if the answer is wrong.

Drawing down retirement to keep a house is a decision, not a default. Before you agree to one, price out three things: what leaves the account, what the house really costs each month (loan, taxes, insurance, maintenance), and what you would live on at 70. Ask your tax professional what a withdrawal costs.

Composite example, not a specific client.

Send me the numbers before you agree to a buyout.

Your decree can list child support as active income. A lender may not count it.

To use support as qualifying income, Fannie Mae's guideline looks for about 6 months of documented, on-time payments and evidence the support will continue at least 3 more years. If your youngest turns 18 inside that window, the income may not count at all.

The decree sets the support term. The lender applies its own rule. Nobody checks the two against each other unless someone asks.

Send this to your mediator and ask them to check the date.

Before your next mediation session, write down three numbers.
1. What the house costs each month: loan payment, property taxes, homeowners insurance. Your mortgage statement or escrow breakdown shows it.
2. What you would set aside each month for repairs. A rough number is fine.
3. What you bring home each month on your own income. If support is part of the plan, note how long it lasts.

Add the first two and compare the total to the third. That comparison tells you whether keeping the house works before you agree to it.

Your divorce decree can say who keeps the house. It can't take anyone's name off the loan. Only your lender can, and it happens one of three ways: refinance, assumption, or release.

All three need the lender's approval, and the person keeping the house generally has to qualify on their own. Check which one your plan relies on before it's in your settlement.

A quitclaim deed changes who owns the house. It doesn't change who owes the loan.

This is the single most common mistake I see in divorce settlements — someone signs off the deed, assumes they're done, and finds out two years later they're still fully liable for a mortgage on a house they don't live in anymore.

If your settlement includes a quitclaim deed and nothing else about the mortgage, stop and ask: who's actually removing me from this loan, and how?

Send this to someone negotiating a settlement right now.
