The CFPB finalized revisions to Section 1071 this month, narrowing the rule's scope and establishing a uniform compliance timeline.

Here's what changed:

➡️ Reporting threshold raised to 1,000 originations
➡️ "Small business" definition narrowed to $1M in annual gross revenue
➡️ Fewer required data fields
➡️ Data collection begins January 1, 2028

The revisions reduce the reporting burden for some lenders. They do not eliminate the need to prepare now.

January 1, 2028.

That date sounds like a lifetime away, doesn't it? But if you work in compliance, you know Jan 1st will be here in no time.

The new Section 1071 proposal offers a single, unified compliance date for all reporters, eliminating the tiered rollout that caused so much confusion previously. This is good news for simplicity, but it also creates a false sense of security for institutions.

In RiskExec's latest webinar, Sarah Brons and Jesse Taylor reminded us that even with this extended 1071 runway, you cannot afford to stop moving ahead. Institutions that pause their 1071 programs entirely often find it twice as hard to restart.
