NMLS & CFL Reports

NMLS Reinstatement Period Ends February 28

The NMLS reinstatement period closes at 9:00 PM PST on February 28. If you have not yet submitted your NMLS renewal, immediate action is required. Licensees who still need assistance should contact our office as soon as possible to avoid compliance issues.

CFL Annual Reports Due March 15

The filing period for CFL Annual Reports is now open. The DFPI Self-Service Portal is active and accepting filings. All reports must be submitted by March 15.

Failure to submit the required reports on time may result in penalty fees and potential revocation of your license.

It's the Purpose that Matters!
Let’s say you’re the lender.

It's an owner-occupied property. The borrower swears the funds are for business—maybe to launch a new company or maybe to expand. You have the Certificate of Business Purpose. It feels solid, so you close.

Six months later? The borrower defaults. Now they’re claiming it was a consumer loan. Their attorney claims you misclassified the deal and misled the borrower.

The DRE gets involved. The DFPI starts asking questions.

Suddenly, your loan file is being investigated as mortgage fraud.

That’s not a scare tactic. That’s California Assembly Bill 3108.

Are Junior Mortgages Doomed After AB 130?
Or, will life go on?

In this article, Dennis Doss (Doss Law, LLP) breaks down what California’s AB 130 really means for lenders and servicers of subordinate mortgages on residential real property.

❗California AB 130 is now law. It just made foreclosing on certain junior mortgages harder.

As of July 1, 2025, California Civil Code Section 2924.13 (AB 130) is operative. It applies to subordinate mortgages on residential real property by imposing new restrictions before a lender or servicer can initiate foreclosure, judicial or non-judicial.

If you service junior liens in California, this applies to you.

Before starting, or even threatening, foreclosure, the mortgage servicer (including self-servicing lenders) must:

▶️ Record and mail a Certificate of Compliance stating either no violation of the statute or listing any violations
▶️ Send the certificate by certified mail, return receipt requested, to the borrower’s last known address
▶️ Understand the risk: a false or incomplete certificate can delay foreclosure or result in the sale being set aside

If it discloses violations, borrowers may raise the certificate as an affirmative defense.
