📢 FinCEN Reporting Update for Real Estate Professionals
A federal court has set aside FinCEN's Residential Real Estate Reporting Rule, meaning reporting requirements are currently on hold.

Here's what you need to know:
✔️ FinCEN reporting is not currently required
✔️ Covered transactions are not subject to reporting obligations at this time
✔️ No action is needed while the court order remains in effect

The rule was originally intended to increase transparency around certain residential real estate transactions involving legal entities and trusts.

The Department of Justice has appealed the ruling, so the status of the rule may continue to evolve. If changes occur, FinCEN is expected to provide additional guidance.
