TALLAHASSEE, FL- On the final day of the 2022 Legislative Session, the Florida House of Representatives could have thrown their constituents a life line but instead chose to let them drown in overwhelming financial obligations.

Florida is a Judicial Hellhole and consumers are paying the price. Despite legislation taking effect in July of 2021, Florida saw over 116,000 property insurance lawsuits last year and insurers sustained losses exceeding $1.7 Billion for the 2nd consecutive year despite no Hurricane activity. And it’s going to get worse.

In January Florida experienced a 37% increase in litigation putting even more pressure on an already failing market. When predatory actors are allowed to manipulate an entire industry, taking advantage of vulnerable citizens in the process, we all pay more.

Once again:

Congress reauthorizes NFIP hours before expiration deadline

Leaving little time to chance, Congress today reauthorized the National Flood Insurance Program through Friday, December 3rd.

Passed as part of short-term, Federal spending legislation, the President is expected to sign this latest reauthorization into law hours before today's September 30th deadline.

The uncertainty created by Congress’s last-minute action has been particularly unwelcome as the NFIP prepares to launch Risk Rating 2.0 on Friday, October 1st.

Governor Ron DeSantis signed SB 76, which builds on Governor DeSantis’ commitment to insurance reform in Florida. This bill protects Florida families by restructuring litigation rules for disputed insurance claims; expressly disallows contractors, public adjusters, and companies from using prohibited advertisements that encourage Floridians to make an insurance claim for roof damage; and imposes a fine of up to $10,000 when companies violate the law.

“Homeowners property insurance rates have increased by 20, 30, 40 percent or higher in some cases,” said Senator Jim Boyd. “Since 2013, $15 billion has been paid out in claims in Florida. From those funds, 71 percent went to attorney fees, 21 percent to insurers defense costs, and a mere 8 percent went to the property owners for their losses. Florida accounted for over 76 percent of all homeowners’ litigation in the country in 2019. With the passage of SB 76, I believe we will see a downward impact on those rates. I appreciate the Governor’s leadership on this issue that will save our constituents on their annual homeowners insurance costs.”
“Florida’s property Insurance market has been in crisis for years,” said Representative Bob Rommel. “Besides weather events, bad actors have been targeting homeowners and insurance companies. Over the past 7 years, insurance companies have paid out over $15 billion in claims, out of which over $10 billion went to attorney’s fees. SB 76 is a big step towards stopping the abusive practices of these few bad actors, where they encourage homeowners to file insurance claims or even lawsuits. We have over 1,100 people a day moving to Florida and we need to ensure that consumers have the ability to obtain affordable insurance policies from private companies and not just Citizens, which was originally set up as the insurer of last resort. SB 76 will stabilize the market and should attract new insurance carriers to Florida.”
During his time in office, Governor DeSantis has been committed to insurance reform and reducing the increasing cost drivers of property insurance. In 2019, Governor DeSantis signed into law HB 7065 to install reforms to the Assignment of Benefits (AOB) process. Find more about those reforms here.
Governor DeSantis has also remained committed to appointing judges dedicated to upholding the Constitution and the rule of law. In total, Governor DeSantis has appointed 119 judges to Florida courts and 5 justices to the Florida Supreme Court. Following the appointment of these principled justices, the Court issued a ruling on December 31, 2020, to adopt the summary judgement standards articulated by the U.S. Supreme Court. These standards, which took effect on May 1, 2021, will reduce needless litigation, forum shopping, and other practices that drive up the price of property insurance for businesses and families

Amid a period of extraordinary uncertainty in Washington, Congress passed Federal spending legislation for the 2021 fiscal year Wednesday night that reauthorizes the NFIP for one year until September 30, 2021.

On November 21, 2019, the President signed legislation passed by Congress that extends the National Flood Insurance Program’s (NFIP’s) authorization to December 20, 2019.

Congress must now reauthorize the NFIP by no later than 11:59 pm on December 20, 2019.

FEMA has deferred the new risk rating 2.0 until October 2021. These are proposed new flood rates and a new rating system that will take into account proximity to a source of flooding, replacement cost of the home and other new rating factors.

WASHINGTON - FEMA is focused on building a culture of preparedness by closing the insurance gap so that individuals and communities recover faster and more fully after a natural disaster.
Earlier this year, FEMA announced Risk Rating 2.0 as an initiative to deliver flood insurance rates that people trust, value, and are less complex to navigate. Knowing the true risk of one’s property is critical to ensure adequate insurance coverage and claim payments after a flood, as well as to inform appropriate mitigation measures property owners can take to ultimately reduce their risk. While the agency initially announced that new rates for all single-family homes would go into effect nationwide on October 1, 2020, some additional time is required to conduct a comprehensive analysis of the proposed rating structure so as to protect policyholders and minimize any unintentional negative effects of the transition. Therefore, FEMA decided to defer the implementation of Risk Rating 2.0 by one year to October 1, 2021. Additionally, this extension allows for all National Flood Insurance Program (NFIP) policies – including, single-family homes, multi-unit and commercial properties – to changeover to the new rating system at one time instead of a phased approach, as originally proposed.
Over the course of the next year, FEMA will continue to actively engage with Congress and other key stakeholders to ensure transparency and visibility as we work to transform the NFIP.
