Everyone’s posting about the MOVE Act like it’s already law. It’s not.
H.R. 10028 — the Making Ownership Viable for Everyone Act — was introduced August 3, 2026 by Rep. Tom Kean Jr. (R-NJ-7) and referred to House Financial Services. It would require Fannie Mae and Freddie Mac to begin purchasing and securitizing portable mortgages within 180 days of enactment, letting a homeowner transfer their rate, terms, and balance to a new property within 90 days of selling the original.
The fine print most posts skip: it’s in committee with a single sponsor, the bill text conditions portability on the lender permitting it, and it does not cover assumable mortgages. Portability moves your balance — not your purchase price — so upsizing still means financing the difference at today’s rates. Separately, FHFA has said it’s evaluating portability administratively, which may be the faster path.
What it would mean for Tahoe: our inventory has been thin for three years because sellers won’t surrender a 3% rate. Unfreeze that and the listing picture changes fast.
