We're wrapping up our wage garnishment FAQ series with a question that's equal parts legal and personal.

Will my employer fire me over a wage garnishment?

The short answer: federal law protects you, at least for a single garnishment.

Under the Consumer Credit Protection Act, your employer cannot legally fire you because of one wage garnishment order. However, that protection has limits. Multiple garnishments from different creditors can change the picture, and not every state provides the same level of protection beyond federal law.

The other reality? Even if you can't be legally fired, garnishment can be an uncomfortable thing to have on your employer's radar. Resolving it quickly is almost always in your best interest.

Week 4 of our wage garnishment FAQ series, and this one comes up constantly.

How long does a wage garnishment last?

The short answer: it depends on the type of debt, and it can last longer than most people expect.

For court-ordered debt, a garnishment typically continues until the full balance is paid off or the order expires (which varies by state). For IRS garnishments, they continue until the tax debt is resolved: paid, negotiated, or settled through a program like an Offer in Compromise.

There's no automatic expiration date. If nothing changes, neither does the garnishment.

From start to finish, an IRS levy can take months, if not years to complete. After it notifies you of its intent to levy your earnings, the IRS can generally continue its collection efforts until it is paid in full. Even so, you can protect yourself financially and legally by understanding how this....

Did you know you may be able to lower or even eliminate IRS penalties if you meet certain criteria?

It's called penalty abatement, and it's more common than most people think. The IRS can reduce penalties for things like filing late, paying late, or underpaying taxes if you have a qualifying reason, like a first-time offense, a natural disaster, or circumstances beyond your control.

There are a few different types, and the process involves formally requesting relief from the IRS. If it's denied, you still have options to appeal.

Continuing our May FAQ series on wage garnishment, and this week's question might be the one that surprises people the most.

Can the IRS garnish my wages without warning?

The short answer: essentially, yes.

Unlike most creditors, the IRS doesn't need a court order to garnish your wages. They do have to send notices, but if those go unanswered (or unnoticed), they can move quickly. By the time many people realize what's happening, the garnishment has already started.

This is why responding to IRS notices early matters so much. Ignoring them doesn't make the problem go away. It usually makes it worse.

Here's what the IRS process actually looks like: https://hubs.ly/Q04fbzX60

If you've gotten IRS notices and aren't sure what to do next, talk to someone who knows. Top Tax Defenders offers free consultations with experienced tax professionals.

We're back with our May wage garnishment FAQ series, and this week's question is one we hear a lot from people who feel stuck.

Can I get a wage garnishment reduced?

The short answer: yes, in many cases you can.

Depending on the type of debt and your financial situation, there are real options: filing a hardship exemption, negotiating directly with the creditor, entering a payment plan with the IRS, or in some cases challenging the garnishment order altogether.

The key is acting quickly. The longer a garnishment goes unchallenged, the harder it can be to reverse course.

This May, we're doing something a little different.

Every week, we're answering one of the questions we hear most from people dealing with wage garnishment because this stuff is confusing, stressful, and the internet doesn't always give you a straight answer.

First up: How much of my paycheck can actually be garnished?

The short answer: usually up to 25% of your disposable income. But there's a protected floor...a portion of your paycheck the law says creditors can't touch.

Here's where it gets complicated: for tax debt, child support, or student loans, the rules change significantly. The IRS can take more, and without a court order.
