The LLC remains one of the most common structures for owning investment real estate.
When partners decide to go their separate ways, a strategy known as a drop and swap may be used. In some cases, this is done one or two years before a sale.
In other situations, especially when debt is involved, the restructuring may occur at closing after the mortgage is paid off.
By retitling the property as tenants in common, each partner may then choose to complete their own 1031 exchange or recognize taxes individually.
Timing, structure, and lender cooperation all matter.
If you are in a partnership and considering a sale, planning early can make all the difference.
