Good morning to everyone and hope you all have had an amazing week. So I'm here with a bit of information to educate everyone who needs to know. This is for customers and business owners who need to educate themselves on the laws of Louisiana. I had to learn this the hard way, in court, and could not recite the law, but now I am prepared and would like you all to be as well.
Customers: When your vehicle is impounded for any reason. Whether it be an accident, no insurance, dui, dwi, arrest, etc. No matter the reason, you will always be asked to provide proof of ownership for said vehicle before being able to retrieve anything from it or for it to be released to you at all. If you can not provide said proof of ownership we CAN NOT help you.
Business Owners: Here are your titles/laws to educate yourself on. Although, I have run this business for over 20 years and know that it is a state law I could not give the information that was needed (my own fault).
RS 32:1713
"Owner" means the last registered owner of a vehicle, the holder of any lien on a vehicle, and any other person with DOCUMENTED proof of ownership of a vehicle. Documented proof or ownership shall include a title, CURRENT registration, or a NOTARIZED bill of sale.
Title 55:1941
Vehicles shall be releases immediately to the vehicle OWNER or lien holder, or authorized representative once PAYMENT is made, any applicable lien holder requirements are met, and any applicable documented law enforcement or department hold orders are released.
If you need clarification as to who an authorized representative would be, that would be a person in possession of a power of attorney for the owner, or a person who has obtained a notarized authorization from the Owner of the vehicle. Along with the owners copy of ID and signature.
I apologize for this being so long but this is for everyone who NEEDS to know. For the few bad reviews and the ones that take us to court because they do not feel the need to prove they own the vehicle. This is for your own security and protection of your property.
