🚨 New Federal Credit Repair Bill Introduced Pay Attention

On January 9, 2025, a bill titled the “Ending Scam Credit Repair Act” (H.R. 306) was introduced in Congress.

Let me be clear:

This is not law yet.

But if passed, it would significantly change the credit repair industry.

Here are the major proposed changes:

▪️ Mandatory State Licensing Nationwide
no one could operate as a credit repair organization without a state license even if your state currently doesn’t require one.

▪️ Stricter No-Advance-Fee Rule
You could not collect payment until:

– At least 6 months after service
– A new credit report is issued
– The report shows the promised result was achieved

That would eliminate many current payment models.
This would be exactly like TSR

▪️ Limits on Repeated Disputes
The bill targets repetitive dispute submissions and requires specific explanations for resubmitted disputes.

▪️ Mandatory Disclosure
Credit repair companies would be required to tell consumers:
“You can do this yourself for free.”
Which we already have to do under current law

▪️ Expanded Recordkeeping
5-year record retention.
Telephone recordings must be preserved.
Copies of all communications must be kept.

▪️ $500 Per Violation Civil Damages
This is not a small tweak.
This would be a structural shift.

Now here’s the real takeaway:

Whether this bill passes or not, the message is clear Congress is watching the industry again.
If you’re operating in this space, you better know the law.
Not trends.
Not hype.
Not shortcuts.

The industry is moving toward tighter compliance, higher standards, and more scrutiny.
