🌳 Tree Damage & Homeowners Insurance — Who’s Responsible? 🏠
One of the biggest misconceptions we hear is:
“If my neighbor’s tree falls on my house, their insurance pays.”
In many situations, homeowners insurance works based on WHERE the tree falls — not who owns the tree.
✔ If a tree falls on your home, fence, garage, or other covered structure, your homeowners policy is usually the first policy involved.
✔ If your tree falls on your neighbors home or structures they would need to file the damages through their own homeowners insurance policy
✔ If the tree was healthy and fell due to wind or storms, it’s often considered an “act of nature.”
✔ However, if a tree was clearly dead, damaged, or neglected, there could be liability considerations.
✔ If a tree falls on your vehicle, this falls under your auto insurance but you must have comprehensive coverage
