In a historic shift for U.S. drug policy, Acting Attorney General Todd Blanche signed an order on April 23, 2026, officially reclassifying state-licensed medical ma*****na from Schedule I to Schedule III of the Controlled Substances Act.

​This move effectively ends decades of federal policy that treated cannabis as a drug with "no accepted medical use," placing it in the same category as substances like ketamine, anabolic steroids, and Tylenol with codeine.

​What This Change Means

​The shift to Schedule III is a monumental "middle ground" that acknowledges the medical utility of cannabis while keeping it under federal oversight.

​Legitimization of State Programs: The order largely legitimizes the medical ma*****na programs already operating in 40 states.

​Tax Relief for Businesses: Perhaps the biggest win for the industry is the removal of the IRS Section 280E burden. State-licensed cannabis businesses can now deduct standard business expenses (like rent and payroll) on their federal taxes, a move expected to save the industry billions.

​Expanded Medical Research: Researchers will no longer face the extreme regulatory hurdles associated with Schedule I drugs, allowing for more rigorous clinical trials on safety and efficacy.

​Doctor-Patient Transparency: It empowers healthcare providers to discuss and recommend cannabis with more reliable, federally supported information.

​What This Does NOT Do

​It is important to clarify that rescheduling is not the same as federal legalization or "descheduling."

​Recreational Use: This order specifically targets state-licensed medical ma*****na. It does not federally legalize adult-use (recreational) ma*****na.

​The "Broad" Rescheduling Process: While this order is immediate for medical products, the broader rescheduling of all cannabis is still subject to an administrative hearing process, currently set to begin in June 2026.

​Federal Prohibition: Cannabis remains a controlled substance. You cannot yet transport it across state lines, and it is still subject to federal regulations.
