Maine Bureau of Consumer Credit Protection The Bureau oversees many aspects of Maine's consumer finance industry: conducting examinations, issuing licenses, and providing educational outreach.

The Maine Bureau of Consumer Credit Protection was established in 1975 to enforce a wide variety of consumer financial protection laws, including the Maine Consumer Credit Code, Truth-in-Lending Act, Fair Credit Billing Act, Truth-in-Leasing Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act, and “Plain Language” Contract Law. The Bureau conducts periodic examinations of creditors

to determine compliance with these laws; responds to consumer complaints and inquiries; and operates the state’s foreclosure prevention hotline and housing counselor referral program. The Bureau also conducts educational seminars and provides speakers to advise consumers and creditors of their legal rights and responsibilities.

The Maine Bureau of Consumer Credit Protection’s phone number, (207) 624-8527, has been used in some spoofing and phishing scams in the last several days.

Spoofing is a type of scam where someone disguises a phone number, email address, sender name, or website URL to convince the recipient that they are interacting with a trusted source. Phishing is an attempt to obtain personal information by pretending to be someone legitimately in need of such information.

Do not share any personal information in response to unsolicited phone calls, texts or emails. Also, do not use the contact information from the caller, click on a link in a text or email, or push a button on your phone keypad.

The Maine Bureau of Consumer Credit Protection will never call, text or email you requesting personal information. If you receive such a call, text or email please notify the Bureau immediately.

Starting today, the U.S. Department of Education (DOE) will begin emailing all borrowers with at least one outstanding federally held student loan to provide updates on potential student debt relief, and to inform them they have until August 30 to call their servicer and opt out if they do not want this relief. It is important to note that the rules that would provide this relief are not yet finalized. Receiving the email does not guarantee specific borrowers will be eligible.

The DOE will provide additional information to borrowers once the rules are finalized this fall. On December 16, 2021, an important milestone was reached in our state’s efforts to participate in the federal Homeowner Assistance Fund (HAF) program. On that day, the US Treasury notified the Bureau of Consumer Credit Protection that the Bureau’s HAF plan had been approved. A link to the approved plan is available on the Bureau's website, www.credit.maine.gov.

The Bureau expects the US Treasury will soon wire to the Maine State Treasury the balance of the $50 million that will come to this state to fund the Maine HAF program. The funds will benefit low- to moderate-income and socially disadvantaged homeowners statewide who can demonstrate they have been economically impacted by the Covid pandemic.

The program is still at least two months away from “going live.” The following tasks remain:

1. The Bureau is awaiting approval of its recommended software provider, which was selected from fifteen bidders that responded to a Request for Proposals (RFP). The software will facilitate the operation of the program, by establishing an electronic portal for applications from homeowners, as well as “back end” processing, and production of the reporting and accounting documents required for federal and state audits of the program;

2. The Bureau must enter into agreements with its non-profit housing counseling and legal assistance partners across the State of Maine;

3. Policies and procedures for eligibility must be established; and

4. Payment processes must be established with mortgage servicers, utility companies and municipalities.

The Bureau has been hearing from many interested parties, including homeowners, non-profit providers, mortgage servicers and others. For those reasons, it’s important to understand the reach of the program, and also its limits:

1. Unlike other recent federal programs in which consumers received payments directly, the Maine HAF program – and similar programs in other states – call for payments to go to creditors of the homeowners. This includes mortgage lenders and servicers, municipalities (for tax liens) and utility companies (for past-due utility payments).

2. At least in its initial phases, funds are available only to those consumers whose household income is equal to or less than the “average median income” for their area of the state. The Bureau will post the specific dollar limits in the near future, so homeowners can check their income eligibility.

3. Consistent with US Treasury’s guidance, before being eligible for Maine HAF funds, homeowners seeking assistance with overdue mortgage payments of any type will be required to demonstrate they have applied for whatever loss mitigation programs are available from their lender or servicer.

The Bureau of Consumer Credit Protection is developing a program to disburse $50 million in assistance to low- to moderate-income and socially disadvantaged homeowners statewide, under guidance provided by the U.S. Department of the Treasury. It’s known as the Maine Homeowner Assistance Fund, or “Maine HAF.”

The Bureau reviewed and incorporated public comments on program design and outreach strategies, and submitted its final draft HAF plan to the US Treasury on August 20, 2021. The Bureau does not anticipate accepting applications from homeowners until at least December 2021.

In the meantime, the Bureau continues to work on:

1. Establishing a portal for benefit applications, “back end” processing, and production of required reporting and accounting;

2. Finalizing the application itself, which will permit income-eligible homeowners to request funds for overdue mortgage payments, utility payments and municipal tax payments, if defaults were attributable to the Covid pandemic;

3. Coordinating with other states’ program directors regarding program development, implementation, and management;

4. Working with Information Technology (IT) and project management professionals at the state to ensure that we meet the state’s requirements for contracts; and

5. Continuing discussions with stakeholders, including representatives of Maine’s recent immigrant population and Maine’s tribal population.

The Bureau of Consumer Credit Protection is developing a program to disburse $50 million in assistance to low- to moderate-income and socially disadvantaged homeowners statewide, under guidance provided by the U.S. Department of the Treasury.

Prior to submitting the proposed plan to Treasury for review and approval, the Agency seeks your comments on program design and outreach strategies. We hope to hear from individuals and groups that work with or have contact with homeowners, including non-profits and CAP agencies, mortgage lenders and servicers, legal service providers, membership organizations representing socially disadvantaged homeowners, utility companies to which bills are owed, and municipalities that hold tax liens on residents’ properties.

The draft plan and a proposed homeowner application are posted on the Bureau's homepage, www.credit.maine.gov for review and comment. To submit a comment, email [email protected]. Please indicate in the email subject line that you are providing comment on the draft plan. Additionally, please provide your name, organization (if applicable) and contact information.

Comments are due to the bureau on or before 5 p.m. Wednesday, July 21, 2021. The bureau will submit the final proposed plan to the US Treasury on or before July 31, 2021.
