Wondering how and when to get started with a 1031 exchange? It begins with a contract.

After ratifying a contract, agents or investors should contact Realty Exchange Corporation to discuss the proposed exchange and obtain the optional contract addendum for selling the property. An exchange agreement and a contract assignment for the Qualified Intermediary (QI) must be signed by both the exchanger and QI before the first relinquished property settlement. A QI must be assigned into the contract to be part of an exchange.

There are two dates that are critical to the exchange – the first is the 45 day ID and the second is the 180-day exchange deadline.  BOTH clocks start the day after you close on the property you are selling – the relinquished property. 

The first is the 45-Day ID due date – this means that by midnight on day 45 your QI must have a list of the properties – with unambiguous locations, such as addresses or tax ID’s - you are intending to purchase. 

The second is the 180 exchange deadline.  This means that you must own the replacement property(ies) – go to closing/settlement on them - within 180 days. Any properties purchased outside of the 180 day exchange window will not receive 1031 treatment.
