Led by the industry’s giants, such as Aladdin Bail Bonds, it is spending several million dollars to collect the 365,880 registered voter signatures required to place a repeal referendum on the 2020 ballot.

There’s virtually no doubt that the referendum will qualify, automatically suspending the new law until voters decide its fate.

The Legislature and Gov. Jerry Brown enacted landmark legislation that eliminates cash bail for criminal defendants and substitutes a system of evaluating pre-trial flight risk. However, the legislation is just the opening salvo of a multi-front legal and political war over the issue.

Assemblyman Bonta and Senator Hertzberg want to abridge defendants right to bail and replace it with unconstitutional risk assessment algorithms. They violate due process because their code is secret. Bail is transparent.

Don’t be fooled. SB 10, sponsored by Sen. Bob Hertzberg (D-Van Nuys) and Assemblyman Rob Bonta (D-Oakland), is an ill-conceived bill that follows the current trend in criminal justice legislation that puts more value on the rights of accused criminals than it does on the health, safety and welfare of crime victims or the greater public at large. They want you to believe that dangerous felons and criminals are the real victims, when nothing could be further from the truth.

The holding of the Humphrey court may have been different if not for the malpractice of the Attorney General. Humphrey is a bad precedent that disregards the constitutional rights of victims in favor of defendants. It would be absurd to release a defendant if the preponderance of the evidence shows he or she presents a danger to the victim or public safety merely because that defendant cannot afford his or her bail or agrees to abide by a stay-away order regarding the victim.
