It has become a boogeyman in public discourse: “mass incarceration.” Both left and right, from Hillary Clinton to Rand Paul, agree that it must be ended. But a close examination of the data shows that U.S. imprisonment has been driven largely by violent crime—and thus significantly reducing incarceration may be impossible.

Barry Latzer writes about the myth of mass incarceration. Violent crime, not drugs, has driven imprisonment. And drug offenses usually are for dealing, not using.

For Example, Jefferson County, Colorado is touted as a pretrial success story. However, recently, statistics have been released about the effectiveness of the pretrial program and the numbers show that the program has failed in every goal that it had. Jail numbers are up, not down as promised by the program creators. Jail length of stays are up and not down as the program promised…and so on and so on. Pretrial also talks about Kentucky as the perfect model of bail because they have no “money bail.” The truth about Kentucky is that even though there is no surety bail, the majority of bail in the state is still cash bail (aka money bail). Additionally, even with no surety bail, the jails in Kentucky are crowded…how could that be? My guess…jail overcrowding has nothing to do with the commercial bail industry.

Washington D.C.'s pretrial program is usually touted as a fairly successful model of bail reform, as Burdeen points out, but what is not highlighted is the fact that this program has a budget of around $60 million to supervise fewer than 6,000 defendants. An effort to replicate the results of that program would represent an incredible expense for any American metropolitan region.

“We’re not getting money for 47. The petitions process requires a significant amount of work. We’ve definitely seen an increase in the complexity of the caseload,” Reisig said. “We’re like a MASH unit. We look for ways to increase efficiency … but it’s been a nightmare. The impact on smaller counties feels like it’s been a major impact because we’re so small.”

It was seen as a chance for a clean slate and a remedy for California’s overcrowded prisons and jails. Proposition 47 allowed current and ex-felons with nonviolent theft and drug possession offenses to petition to have their crimes reclassified as misdemeanors.

Seriously? County departments don't track the ebb, flow and varying costs of their work? Apparently not, at least not in any particularly useful manner.

The Los Angeles County auditor reported Tuesday that Proposition 47 has generated millions of dollars in cost savings , but the most significant part of his findings had to do with the county's jarringly inadequate grasp of the basic numbers that describe and measure its workload.
