NEW LAW ALLOWING EMAIL DELIVERY OF LANDLORD-TENANT NOTICES
A newly passed landlord tenant law known as Section 83.505 Florida Statutes allows both the landlord and the tenant to elect to receive notices by email by signing an agreement . With this agreement the landlord can make a claim on the tenant’s security deposit by e-mail instead of certified mail. Also 3 day notices may now be emailed instead of hand delivered

A landlord called today. she had a dispute with a tenant who had moved in a relative in violation of the lease. She issued a 7 day notice for incurable lease violation - the wrong notice. She demanded a double security deposit. Eventually the parties agreed that the tenant could vacate early. Then the landlord did not return the security deposit and did not send the claim within 30 days as the law requires. Now she is being sued by the tenant, not only for wrongfully keeping the deposit (mandatory attorneys fees) but also self help eviction for the tenant leaving early ( a fine of 3 x rent) AND a complaint for discrimination for objecting to the relative moving in, plus a jury trial. The landlord is looking at more than $10,000 in legal fees to the tenant’s lawyer and maybe the same for her own lawyer. She did not seek any legal advice until she was served with a summons. Dont wait to get legal advice !

What does the landlord have to do to claim the tenant's security deposit ?

The landlord is required to mail a claim to the tenants best known address by certified mail postmarked no less than 30 days from the end of the tenancy. The claim must contain specific language ( you can get the correct form on this website). If the tenant has not provided a forwarding address, the claim should be mailed to the vacated unit. Exceptions: 1) if both parties have executed an electronic delivery agreement, the claim may be emailed. 2) the tenant vacates prematurely and has not provided the landlord a forwarding address by certified mail or personal delivery 7 days in advance.
