So… could the NAR settlement, that just flipped the real estate industry on its head, get tossed out?

Today (Wednesday, January 14, 2026) the 8th Circuit Court of Appeals hears arguments that could undo the approval of the NAR settlement — the one that rewrote how Realtors operate and get paid.

The issue isn’t whether the settlement is popular. It’s whether it was even approved properly.

A law professor, Tanya Monestier, filed a 136-page objection arguing that the judge didn’t independently review the settlement and instead copied heavily from the plaintiffs’ proposed order while brushing aside objections.

If the appeals court agrees, the approval gets tossed and the case goes back to court.

So this week is about whether a court casually restructured an entire industry and called it due process.

And spoiler: the answer might be no.

📣 Housing Market Update —
Government officials have announced plans to pursue purchases of large amounts of mortgage-backed securities (mortgage bonds) as part of an effort intended to support housing affordability. The goal is to help put downward pressure on mortgage rates; timing, structure, and impact have not been finalized.
🧠 What this means:
Mortgage-backed securities are bundles of home loans sold to investors. When demand for these bonds increases, it can help lower the interest rates tied to mortgages — but rates are still influenced by many factors such as inflation, the broader bond market, and Federal Reserve policy.
