A new California law (AB 570) expands the definition of "dependent" for the purposes of enrolling in a Qualified Health Plan to include a parent or stepparent of a qualified consumer.

Under IRS rules, this includes a parent or stepparent for whom the taxpayer provides over one-half of the individual's support.

Carriers will be required to provide coverage if the dependent resides in the carrier's service area.

Please note this only applies to individual and family plans on and off the exchange and does not apply to other coverage such as dental and vision.

Family Glitch Solution Proposed

The Biden Administration announced today that it would release a proposed rule to fix the “family glitch”.

The Department of Treasury is using the proposed rule to revise the definition of "affordability" of employer sponsored coverage as it applies specifically to family members of the employee.

Current regulations define employer-based health insurance as “affordable” if the coverage solely for the employee, not for family members, is affordable, making family members ineligible for a premium tax credit.

The proposed changes would allow for the family members of workers who are offered affordable self-only coverage but unaffordable family coverage to qualify for premium tax credits in the exchange. The change, however, would not allow the employee to access a premium tax credit if the employee’s offer of coverage from the employer is deemed affordable under the current standards.

Under the proposal, the earliest this change would be enacted would be January 1, 2023.

A message from Covered California . . .

Due to a recent system issue, one or more of your consumers may have received or will receive multiple NOD01 eligibility notices with a miscalculation of their APTC, and their May bill from their carrier may show an outdated net premium amount. No action is required by you or your consumers to correct this error. Consumers should pay the amount listed on their May and June bills from their health insurance carrier so they can maintain their coverage. Carriers have received the corrected data from Covered California, and in most cases, June bills should show the correct monthly net premium for the remainder of 2021. Covered California has corrected the issue so that consumers’ enrollment and APTC as it currently shows in the system is correct.

If you’re an app-based delivery driver for DoorDash, Lyft, Uber, etc. and qualify for a health care stipend per Proposition 22, you will likely need to provide proof of coverage as a condition of payment.

The American Rescue Plan was signed into law by President Biden on March 11. The new law increases the amount of premium assistance available through Covered California and removes the “cliff” that makes people ineligible for subsidies if their income exceeds 400% of the Federal Poverty Level. Covered California will be providing agents with an FAQ in the coming days which we’ll share with you.
