🎉 Big News for Texas Cottage Food Entrepreneurs! 🎉
Starting September 1, 2025, Senate Bill 541 brings the most sweeping expansion to Texas Cottage Food Law yet—set to boost creativity, reach, and growth for home-based food businesses.
Here’s what’s changing:
* Nearly all homemade foods are now allowed, except high-risk items like meat, seafood, raw dairy, low-acid canned goods, ices (ice cream, popsicles, gelato), and CBD/THC products. This means cheesecakes, cream pies, cut fruits/veggies, banana pudding, vegetarian casseroles, hot meals (meat-free), and more, are now permissible!

* The annual sales cap triples from $50K to $150K, and will now be indexed for inflation—creating more room to grow.

* Wholesale opportunities open up! You can now sell non-refrigerated cottage foods through registered Cottage Food Vendors (like retail stores, cafés, farm stands), making it easier to expand beyond direct sales.

* No more permits or fees—production and sampling of cottage foods remain free from local licensing or inspection requirements. That’s a clear win for simplifying operations.
* Privacy enhancement: Want to keep your home address off your labels? Register with DSHS to get a unique identifier you can use instead. Labels also now require a clear statement:
“THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.”
* If you sell items that require refrigeration (like cheesecakes or refrigerated pies), you must register with DSHS (rules pending), include a “prepared on [date]” label, and a safe-handling instruction (in 12-pt font) like:
“SAFE HANDLING INSTRUCTIONS: To prevent illness from bacteria, keep this food refrigerated or frozen until the food is prepared for consumption.”
