Legal malpractice, as well as many professional liability insurance, is what's called a "claims-made policy," meaning a policy must be active when a claim is made as well as when an incident, error or omission occurs. A gap in coverage can occur if renewal requirements aren’t met or payment is late, creating a lapse during which no coverage applies. If restarted, the prior acts date resets to the new policy start date, meaning allegations before that date may fall outside coverage. Continuous coverage is key. Have you ever thought about attempting to map out a strategy to achieve guaranteed year-over-year revenue growth for the firm? At the same time, a good number of law firms fail to achieve the growth they desire. How is it that both of these factors co-exist? Tail coverage, formally called an extended reporting endorsement, is often the final piece of your legal malpractice insurance. It is used for events like retirement, disability, leaving private practice or even death. Continuity of coverage is extremely important, you must have a policy in place both when an incident occurs and when the claim is reported. That’s where tail coverage comes in. The number one question we get asked by our insureds is, 'What limits do I need?' It's a tough question to answer, because no magical formula exists. If insureds can tell us what they'll be sued for, we can set the limit very accurately. Absent that ability, we have to focus our attention on other factors.

Setting coverage limits isn’t one-size-fits-all. Most people carry far too little: data shows only around 20% of policies with $100K per claim limits are actually sufficient. It may cost significantly less than you image to double that coverage. Factors like matters handled, average claim severity, and career exposure are important when choosing your limits.
