When OAMIC receives a claim involving an estate, whether that is a trust document or a will, the issue often is "was the client competent at the time the estate document was executed?" The lawyer should be careful to fulfill continuing commitments to the client both to represent their interest and, in some situations, to seek additional help for the client. Once the lawyer sees or is advised there may be an issue with competency, the lawyer needs to document all actions taken to verify competency and why the attorney was satisfied the client was competent to execute the estate documents.

A “prior acts” (or retroactive) date is when coverage begins. Claims for incidents that occurred before this date aren’t covered. Maintaining continuous coverage preserves your original prior acts date; lapses can restrict coverage only to incidents after new policy start dates. Wire transfer scams often involve impersonation, and sometimes they also include a fraudulent cashiers checks. The check appears legitimate, but after sending excess funds back, the firm loses money. Prevention requires verification procedures, dual authentication, and awareness — and it's important to note these scams are typically NOT covered by any cyber policies.

Contrary to popular perception, business transaction and commercial law is a high-risk area of practice for attorneys. A lot of what lawyers write is for others in the practice of law, like fellow attorneys or judges. But, when communicating with nonlawyers, like your clients, you may need to make your writing more layman-friendly. Try to avoid acronyms and jargon, limit capitalization to only proper nouns, and consider having it proofed by a nonlawyer reviewer. The goal: clear, accessible writing that communicates effectively.
