Tip for the Day:

A worker can be both employee and Independent Contractor:

Both the IRS and the Tax Court have affirmed that a worker can be both an employee and an independent contractor (IC).

For example, Salaried employees who have a business in which they provide services to their employer. The salary is reported on a W-2 with appropriate withholding, but if payments to the employee’s outside business are over $600 for the year, they are reported on a 1099 with no withholding and no payroll taxes.

Because the IRS and state tax agencies have sharply increased scrutiny of worker classification and the IRS closely reviews the status of any worker who receives both a W-2 and a 1099 from the same issuer in the same year, be ready to make sure that the IRS respects its own dual-status policy. AIPB tip: Document the validity of dual status workers’ employment status with up-to-date job descriptions. Document their IC status with written agreements, invoices for work done as an IC, evidence of the IC doing the same or similar work for other firms, the degree of control the IC has over how and when the IC work is done, and the IC’s opportunity for profit or loss.
