This is a complex issue and the reason any business offering plans governed by ERISA should carry Fiduciary Liability coverage. Even if you do not manage your company's investments, you do choose who does. That in itself is a fiduciary responsibility. Besides, it is very inexpensive coverage to purchase and grants you one less business decision to worry about.
