New York State Paid Sick Leave ( ) Law Effective on September 30th, 2020

Starting on Sept. 30th employers in New York State must allow employees to begin accruing sick leave in a calendar year. However, employees can't use the accrued sick time until January 1, 2021.

The amount of time that employees are allowed to accrue is based upon the employer’s size and net income as listed below:

1. Employers with 4 or fewer employees with a net income of $1 million or less must provide employees up to 40 hours of unpaid sick time.

2. Employers with 4 or fewer employees and a net income greater than $1 million, as well as employers with 5 to 99 employees, must provide employees up to 40 hours of paid sick time.

3. Employers with 100 or more employees must provide employees up to 56 hours of paid sick leave.

Sick time can be used for the following reasons:

• The employee's or a family member's mental or physical illness, injury, or health condition, regardless of whether such illness, injury, or health condition has been diagnosed or requires medical care at the time that the employee requests the sick leave;

• The employee's or a family member's diagnosis, care, or treatment of a mental or physical illness, injury or health condition, or for preventive care; or

• An absence from work due to any of the following reasons when the employee or a family member has been the victim of domestic violence, a family offense, sexual offense, stalking, or human trafficking:

• to obtain services from a domestic violence shelter, r**e crisis center, or other services program;

• to participate in safety planning, to relocate temporarily or permanently, or to take other actions to increase the safety of the employee or employee’s family members;

• to meet with an attorney or other social services provider to obtain information and advice on, and prepare for or participate in, any criminal or civil proceeding;

• to file a complaint or domestic incident report with law enforcement;

• to meet with a district attorney’s office;

• to enroll children in a new school; or

• to take any other actions necessary to ensure the health or safety of the employee or the employee’s family member or to protect those who associate or work with the employee

Employees can be limited to using, depending on the employer size, either 40 or 56 sick hours per year and have the ability to carryover their unused but accrued sick time into the following calendar year.

New FAQ for Families First Coronavirus Response Act ( )
Emergency Sick & Family Leave

The U.S. Department of Labor recently released a new FAQ for the FFCRA's Emergency Sick & Leave that specifically talks to across the country. As you may have seen, heard, or even experienced, schools are now communicating their plans.

Some schools have decided to conduct In-Person learning throughout the school week, while some have decided to execute a hybrid program of sorts (a combination of In-Person & Remote/Online Learning), and others have decided to implement Remote/Online Learning for the entire school year. Here are key points to understand:

• A child's school is deemed to be "closed" if the physical location is closed & instruction is being executed online.

• An who decided to home-school their child while school is considered open, is then considered ineligible for FFCRA wages.

• An employee who chooses to have their child participate in Remote/Online Learning while the child's school is considered open, will more than likely not be eligible to receive wages as well.

• *Note: Recommendation to self-quarantine is not the same as a health care recommendation for Remote Learning.

• Under a Hybrid-Learning schedule, employees are considered eligible for FFCRA wages on the days their child does not physically attend school.

• *Note: This is where the N.Y. 2nd District Court ruling comes into play. The DOL originally stated that an must consent to intermittent leave. The court struck that requirement as unreasonable.

• If a child's before-school or after-school program is closed, then the employee is considered eligible for FFCRA.

• An employer cannot deny FFCRA leave to an employee that previously worked during a school closing.

• Parents cannot take FFCRA leave simultaneously for a child whose school or car provider is closed.

• Essentially, the point is grounded in the notion that there isn't a need for 2 people and/or parents to take care of 1 child for a single day. Yet, there is nothing prohibiting 1 parent and/or person to care for the child on certain days while the other parent and/or person cares for the child on opposite days.

• FFCRA leave is only valid for those who care for a non-disabled child or children up to the age of 18. For disabled children over the age of 18 whose regular school or care provider is closed, employees are eligible for FFCRA leave.
