Do you hire independent contractors and issue them 1099 forms? Many business owners assume that means they don’t need Workers’ Compensation coverage. But it’s not always that simple.

Receiving a 1099 instead of a W-2 doesn’t automatically mean someone is legally considered an independent contractor. What matters is the actual working relationship and how the work is performed.

Imagine this: a worker falls from a ladder while working and breaks an arm.

They may go to the hospital and provide their personal health insurance information. They will receive medical care, but once the insurer learns that the injury happened while the person was working, it may ask questions about how the injury occurred and determine whether Workers’ Compensation should be responsible for the claim.

And if someone was classified as a 1099 contractor but should legally have been considered an employee, not having required Workers’ Compensation coverage can become a serious problem for the business.
