Since its windy today, so let’s talk tress and homeowners insurance
One of the biggest myths in insurance is that “If my neighbor’s tree falls on my house, their insurance pays.”
Not true!
Here’s the real rule:
Insurance follows where the damage lands.
So if a tree hits your house, your homeowner’s policy covers it — even if the tree came from next door.
When is the neighbor actually responsible?
Only if the tree was clearly dead or neglected and they had been warned. In that case, your insurance may pay the claim first, then try to recover from them.
Pro tip:
I always tell my clients — if your neighbor has a dead or dying tree, or branches hanging over your property, take photos and document it.
If the tree ever causes damage, that proof can help your carrier pursue the neighbor for negligence.
What about cleanup?
If the tree hits a covered structure, your policy usually covers removal up to a set limit.
If it just falls in the yard and hits nothing… most policies don’t cover cleanup.
Storm damage vs neglect:
✓ Healthy tree blown over by wind or storms = covered
✗ Dead or rotted tree your neighbor ignored = may lead to subrogation
Bottom line:
Your house = your insurance, regardless of whose tree it was.
