Beware of the Fine Print; if you are a framing contractor, Excavator or General Contractor you should be aware that Acuity has a subsidence or earth movement exclusion on their General Liability Policies, as do most insurance carriers in Colorado here is an example of what can happen, another agent in our office shared this yesterday:

"I wrote a GC two years ago. He was with Acuity and I placed him with an E&S carrier. It was about double the price but I explained to him that the E&S carrier does not exclude Earth Movement. This was reason enough for him to switch."

"Lo and behold, and he files a claim last month with Acuity for construction defect that took place about 3 years ago. Welp, Acuity is denying the claim because it falls under Earth Movement."

You will be surprised how many people are unaware of that exclusion.

Underinsured and Uninsured Motorist Coverage;

I received this experience from one of the personal lines agents in our main office this morning;

Here’s a sad scenario that occurred about a week ago – I friend from my teen years that lives in Houston area – had a seizure after while driving – or they are pretty sure that’s what happened. He had a history of seizures but had them under control and had not had one in a very long time. Anyways – he hit another vehicle causing it to burst into flames and then 3 other cars ended up in the accident as well. 2 people died (including my friend) / 1 had major injuries and was life flighted and then there were lots of other injuries as well. It was a horrific crash.

There is no way his insurance despite the best level of coverages is going to cover all of this – just another reason it’s critical : ( so very sad.
