Making fake pay stubs to secure an apartment will be a felony in Florida.

Beginning October 1, 2026, is implementing House Bill 1293 (HB 1293), making it a third-degree felony to knowingly use fake paystubs, falsified bank statements, or fraudulent identification to secure and take possession of a rental home.

The new law introduces a brand-new criminal offense known as “fraudulent entry of a residential dwelling unit”.

Landlords previously had to handle application lies through slow, expensive civil eviction courts. Now, using fake documents is a third-degree felony, which carries potential prison time and heavy fines under Florida State Statutes.

Landlords do not have to wait for criminal proceedings to finish. They can immediately issue a non-curable 7-day notice to vacate. If the tenant does not leave, the eviction process can start right away.

The law specifically penalizes fake income documents (paystubs, bank logs), forged IDs, synthetic identities, and impersonating someone else during the application phase.

Lawmakers passed the bill following a sharp rise in online document-forging services and rental identity theft, which have caused massive financial losses for property owners.
