SMAR Founder and CEO Maryia Lemiaza .lemiaza will be speaking at TEDxUlicaMińska Women in Warsaw! 💙

This is wonderful news for us and another proud moment for the entire team!

A few months ago, Maryia's idea was selected from a large number of submissions, and she was invited to share it at TEDx.

TEDx is an opportunity to share an idea that can inspire others, challenge the way we see things, and spark important conversations.

Preparations for the talk have been underway for several months. We’re keeping the topic under wraps for now, but we can say that it’s closely connected to Maryia’s personal experience and the work she has been doing and the business she has been building for years.

As Maryia is currently in the US, she will be delivering her talk online. The TEDxUlicaMińska Women conference itself will take place in Warsaw on November 7.

Spotting a Tax Risk in Time

Sometimes, a tax risk can arise from a routine payment.

If the value of a transaction exceeds PLN 15,000 and an invoice issued by an active VAT taxpayer is paid to a bank account that is not included on the VAT White List on the date the transfer is initiated, the transaction requires additional checks.

Why does this matter?

A payment made to an account that is not on the White List may have tax consequences, including the inability to treat the relevant amount as a tax-deductible expense.

These negative consequences can be avoided by submitting a ZAW-NR notification on time. The notification must be filed within 7 days of the date the bank transfer is initiated.

This is why, when making payments, it is important to check:

• the value of the transaction;
• the counterparty’s VAT status;
• whether the bank account is included on the White List;
• whether a ZAW-NR notification needs to be filed on time.

Checking this several months later is not enough, as the deadline for submitting the notification may already have passed.

Spotting a tax risk in time is often much easier than dealing with its consequences later.

Now is the time to check

For companies in Poland whose financial year coincides with the calendar year, the annual financial statements must be approved no later than six months after the end of the financial year and filed with the Repozytorium Dokumentów Finansowych (RDF, Financial Documents Repository) within 15 days of their approval.

If the financial statements are approved on the last permissible day, the filing deadline falls on 15 July.

There is an important distinction here. Preparing and signing the financial statements does not yet mean that they have actually been filed with the RDF.

We are increasingly seeing cases where companies are confident that all the necessary steps have been completed, only to discover upon checking that their financial statements are missing from the RDF.

In our experience, the issue often extends beyond the most recent reporting period. Financial statements for previous years may be missing as well.

Even if an accounting firm prepared the financial statements and supported the process of signing and filing them, it is still worth checking the final result. Preparing, signing, approving and filing the financial statements are separate stages of the process.

Filing financial statements within the statutory deadline is mandatory. Under Polish law, failure to file financial statements with the relevant court register may result in a fine or restriction of liberty (Article 79 of the Polish Accounting Act).

In addition, missing financial statements may lead the KRS to initiate proceedings to compel their filing, and prolonged failure to comply with this obligation may result in further consequences for the company.

You can independently check which reporting periods your company’s financial statements have been filed for in the RDF using its KRS number.

Our recommendation to company owners and business leaders in Poland is simple. Check your company’s details in the RDF and make sure that its financial statements have been filed for all required reporting periods.

5 Years of SMAR Poland ✨

In 2021, we opened the SMAR office in Poland. Expanding into the Polish market was a natural next step in the company’s growth, while also marking the beginning of a new chapter. A new country, a new market and the opportunity to apply our experience in a different business environment. This decision was also shaped by our clients, many of whom were beginning to grow their businesses in Poland. We were glad to grow alongside them. We started with five clients and a team of three.

Over the past five years, we've achieved:

• 530+ projects delivered
• More than PLN 9 million in VAT refunds secured for our clients in 2025 alone
• HR and payroll support for around 300 employees
• 150+ internal guidelines and 560+ knowledge base updates
• 120+ tax audits successfully supported by our team, covering VAT refunds, Estonian CIT, ZUS and HR compliance
