Debt collector says you have 48 hours to pay or face judgment?

A payment deadline isn’t proof that a court judgment exists. Under Regulation F, an FDCPA-covered collector cannot misrepresent a debt’s legal status or threaten legal action that cannot lawfully be taken or isn’t intended.

Before reacting, ask for the court name, case number, filing date, and service information—then verify everything independently. Never ignore an actual summons or court deadline.

That deadline may be real, but it doesn’t explain what the payment actually resolves. Debt collector says you must pay today or your account will be flagged for immediate full-balance collection?

“Flagged” may describe an internal collection status; it does not automatically create a new legal consequence. A right to accelerate the full balance may already exist under the original agreement or applicable law, but an FDCPA-covered collector cannot falsely represent the debt’s character, amount, or legal status—or collect amounts not authorized by the agreement or permitted by law.

Ask the collector to explain in writing what action is actually intended, the contractual or legal authority supporting the full-balance demand, and how the current balance was calculated. You can decline to make a payment during the call.

Debt collector says wage-garnishment papers are being prepared right now?

For most ordinary consumer debts, a creditor generally must sue, obtain a judgment, and secure a garnishment order before an employer can be required to withhold wages. Taxes, child support, certain federal student loans, and some government debts may follow different administrative procedures.

Regulation F prohibits an FDCPA-covered collector from representing that garnishment will occur unless the action is lawful and the collector or creditor intends to take it. Ask for the court or agency name, case number, judgment or order date, and the amount being enforced—then verify everything independently.

Debt collector calling about a debt from six years ago?

Six years alone does not determine whether the collector can still sue. The applicable statute of limitations depends on the type of debt, state law or the law selected in the agreement, and when the legal claim began to run. The last-payment date can be important, but it is not always the only date that matters.

Regulation F prohibits an FDCPA-covered collector from suing or threatening to sue on a time-barred debt. However, collection contact may still be permitted, depending on state law. In some states, making a payment or acknowledging the debt in writing may restart the limitations period.

If you submit a written dispute within the validation period, collection of the disputed amount generally must pause until the collector sends verification or a copy of a judgment. Federal law does not automatically require an original account agreement, a complete chain of ownership, or certified-mail delivery in every case.
