Possible Regulations for Wholesalers!
Real estate wholesalers serve as deal finders and matchmakers within the investment ecosystem. They identify distressed or off-market properties, negotiate favorable purchase terms with sellers, and then assign those contracts to investors—typically flippers or landlords—for a fee.
Key points about wholesalers:
* They generally do not purchase or own the property
* Their income comes from an assignment fee, not rent or appreciation
* They focus on motivated sellers (foreclosure, probate, inherited properties, tired landlords, etc.)
* Success requires strong marketing, negotiation skills, and a solid buyer network
* The barrier to entry is relatively low, but legal and regulatory rules vary widely by state and locality
Wholesalers are essentially the front end of the investor pipeline. They generate deal flow so investors can focus on what they do best—funding, rehabbing, and operating properties.
Any seasoned investor has worked with both excellent wholesalers and not-so-great ones. Because of this range in quality and practice, some states have begun taking steps to regulate wholesaling activity. Now, Denver is turning its attention toward wholesalers through proposed municipal regulations aimed at increasing accountability.
It’s important to note that these efforts are currently focused on wholesalers—not real estate investors. However, what officials say today and what ultimately becomes law can be very different. As investors, we must stay informed and engaged. What happens in Denver often sets a precedent, flowing into surrounding cities and potentially rising to the state level.
By contrast, real estate investors purchase outdated, neglected, or distressed properties and invest significant time and capital to transform them into safe, modern, and attractive homes. These improvements strengthen neighborhoods, reduce blight, and frequently increase property values for surrounding homeowners.
