Montana’s building industry and property owners are facing a serious threat. Senate Bill 358—a result of the DNRC’s “Comprehensive Water Study”—is a drastic overreach that will restrict access to groundwater, hinder development, and drive up housing costs across our state.

🏡 WHAT SB 358 WOULD DO:
🔹 Divide Montana into green, yellow, and red zones for groundwater access
🔴 Red Zones (Bozeman, Missoula, Helena, Ravalli County): Most new wells permanently banned; no new subdivisions without expensive and time-consuming water rights
🟡 Yellow Zones (Billings, Kalispell): Under study and could become restricted next
🟢 Green Zones: Severe limits on water usage per lot and subdivision size
🔙 Applies retroactively to 2014, restricting water use on lots created after that year
💰 Will raise housing costs, delay development, and hurt Montana’s growing communities

This is a poor response to the Horse Creek ruling—and there is no strong evidence that exempt wells are harming senior water rights. We believe there are better, more balanced solutions that don’t threaten our economy or housing supply.
