How to Protect Yourself with Business Insurance When You Subcontract Work

If you're a business owner who uses subcontractors, protecting yourself with the right insurance coverage is essential. Subcontracting can be a smart way to scale your operations, but it also comes with added risk—especially if something goes wrong on a job. Here’s how to make sure you’re covered:

1. Require Proof of Insurance from Subcontractors
Before any subcontractor steps onto a job site, request a Certificate of Insurance (COI) that shows they carry general liability and (if applicable) workers’ compensation coverage. This protects you from being liable for their mistakes or injuries.

2. Use Strong Contracts
Every subcontractor should sign a written agreement that includes:

An indemnification clause (holding you harmless for their work),

Insurance requirements, and

A clear scope of responsibilities.

This legal protection helps limit your liability if an issue arises due to their work.

3. Carry Your Own Business Insurance
Even with well-insured subcontractors, you need your own protection. At minimum, consider:

General Liability Insurance – Covers property damage or injury claims.

Professional Liability Insurance – Covers errors or omissions in your work or subcontractor oversight.

Workers’ Compensation – If you're required to carry it, or if a subcontractor is misclassified, you could be liable.

4. Consider Adding an Additional Insured Clause
Ask your subcontractors to list you as an “Additional Insured” on their liability policies. This gives you direct coverage under their policy if a claim arises from their work.

5. Regularly Review and Update Your Coverage
As your business grows or takes on different types of work, revisit your insurance needs. What worked last year might leave you exposed today.

Bottom Line: Subcontracting can help you get more done—but it shouldn’t leave you more vulnerable. Talk to an insurance professional who understands your industry to make sure both you and your business are fully protected.

PEO vs ERO: What's the Difference for Workers' Compensation?
When it comes to managing workers' compensation, businesses often consider partnering with a Professional Employer Organization (PEO) or Employee Rental Organization (ERO). While both models offer benefits, they differ significantly in their approach and implications for workers' comp.
PEO:
A PEO enters into a co-employment relationship with your business, sharing certain employer responsibilities, including workers' compensation. This means the PEO assumes some liability for workplace injuries and manages claims.
ERO:
An ERO, on the other hand, becomes the sole employer of record for tax and insurance purposes. This model transfers the entire workers' compensation responsibility to the ERO.
Key differences:
Liability: PEOs share liability, while EROs typically assume full liability for workers' compensation.
Control: PEOs often work closely with your business to manage claims, while EROs may have more control over the process.
Cost: Both models can offer cost savings, but EROs might provide more predictable expenses.
Which is best for your business?
The choice between a PEO and ERO depends on your company's specific needs, risk tolerance, and HR requirements. Consider factors like:
The size and complexity of your workforce
Your budget and risk management strategy
The level of control you want to maintain over workers' compensation
Ultimately, carefully evaluate both options and consult with experts to determine the best fit for your business.

Here's the difference between an ccip and a ocip.

OCIP (Owner Controlled Insurance Program) and CCIP (Contractor Controlled Insurance Program) are both insurance programs designed to provide coverage for construction projects, but they differ primarily in who controls the insurance.

1. **OCIP (Owner Controlled Insurance Program)**:
- **Controlled by the Owner**: The property owner or project sponsor purchases the insurance and controls the policy.
- **Coverage**: Typically includes general liability, workers' compensation, and excess liability for all contractors and subcontractors on the project.
- **Benefits**: Simplifies insurance management, potentially lowers costs for contractors, and provides broader coverage.

2. **CCIP (Contractor Controlled Insurance Program)**:
- **Controlled by the Contractor**: The prime contractor or general contractor purchases the insurance.
- **Coverage**: Similar to OCIP, it generally covers general liability, workers' compensation, and excess liability, but primarily protects the contractor and their subcontractors.
- **Benefits**: Provides the contractor with more control over the insurance process and can streamline claims handling.

Both programs aim to improve safety and reduce the complexity of managing multiple insurance policies on large projects.
