Hailstorms Are Most Common in Spring because cold air from the Northern United States clashes with humid and warm air from the Gulf of Mexico. This clash of air masses sets the stage for severe weather such as thunderstorms over parts of the central and southern portions of the United States. Storms that result from this air mass collision can contain tornadoes but most commonly large hail is often associated with these thunderstorms in the spring time. William Clark, an AccuWeather Storm Warning Meteorologist has stated that “The main reasons that hail occurs with the greatest frequency during the spring is that the jet stream and energy higher up in the atmosphere is still rather strong as compared to the summer months.”

Hail stones tend to develop because air rises in a thunderstorm, often called an updraft. The air that rises has water droplets in it and the droplets freeze in the below freezing temperatures up in the air’s atmosphere. As the droplets get larger and heavier, they fall to earth. The stronger the updraft, the larger the hail stones become. In the spring time verses the summer, the freezing levels in the clouds are much lower, causing the hail to more easily reach the earth’s surface. This is because the hail stones have a shorter distance to travel in the air before hitting the ground and it is less likely the hail will melt in the air before they make landfall. The freezing layer in the atmosphere is lower in the High Plains and Mountain West regions of the United States, this is why more hail stones fall in this area of the United States than in any other area. South Central United States (including San Antonio, Texas) sees more hail than anywhere else because the hail making ingredients are ideal during the Spring. Hail in this region has the tendency to grow as large as baseballs and can cause significant damage to homes and roofs leading to millions of dollars in damage in just a few minutes. It is noteworthy that in 2016, a hailstorm in San Antonio, Texas led to an estimated one billion dollars of damage to home and vehicle owners.

During the spring, hail storms are also common in the western United States such as California. Hail stones that are associated with thunderstorms on the West Coast typically are smaller and range from pea to quarter size hail. The quantity of hail can still be destructive. In February of 2018, Sacramento, California was hit with several inches of pea sized hail that covered roads and highways disrupting traffic for hours.

Although Hailstorms Are Most Common in Spring, autumn is the second most common time of the year to have hailstorms occur. Autumn is also hail season because air high in the atmosphere cools down again and heat and moisture at the earth’s surface is still quite high. These are good ingredients for producing hail and this tends to occur in parts of the Midwestern and Eastern United States.

If you have been affected by hail, made a hail claim and you believe that your insurance company is operating under bad faith and delaying paying your claim or low balling you with an offer that does not even come close to the amount of money needed to repair your home, contact me, an experienced San Antonio hail claim attorney immediately for help.

MOST FREQUENT QUESTIONS ASKED TO OUR SAN ANTONIO HAIL ATTORNEYS

Our experienced San Antonio Hail Attorneys have compiled a list of the MOST FREQUENT QUESTIONS ASKED TO OUR SAN ANTONIO HAIL ATTORNEYS regarding the hail storm claim process.

Question: I purchased my home insurance through an insurance agent. Will the insurance agent look out for my best interest in the hail claim process?

The short answer is NO. This is one of the MOST FREQUENT QUESTIONS ASKED TO OUR SAN ANTONIO HAIL ATTORNEYS. Your insurance agent looks out for the best interest of the insurance company. Do not count on your insurance agent to look out for your best interest. The insurance agent has the company’s best interest, specifically the bottom line at heart. Additionally, the insurance adjuster who usually comes to your home following a hail storm to assess the damage and come up with a repair estimate is paid by the insurance company and they usually underestimate and low ball the actual damage estimate to save the company that signs their paycheck money. However, an attorney you hire and the experts that they hire will be there working for you, loyal to you. It is preferable to have professionals who represent you, working for you, as opposed to hoping that adjusters or agents that work for the insurance company do the right thing by you.

Question: What are some of the things to look out for when hiring a roofing contractor to help make repairs to my home?

This is another one of the MOST FREQUENT QUESTIONS ASKED TO OUR SAN ANTONIO HAIL ATTORNEYS. Unfortunately, when hail storms strike the San Antonio and surrounding areas, roofing contractors pop up all over the place. You will get bombarded with emails, mail flyers, commercials and even door to door salesmen. Be extremely cautious of these contractors. Many are scam artists. Perform your research before you hire any roofing contractor. Ask for job referrals, Google them and determine if they have been in business for several years at least. It is a good idea to even contact the Better Business Bureau before you sign any agreement for work to be performed to determine if they have a positive rating and good reviews.

MOST FREQUENT QUESTIONS ASKED TO OUR SAN ANTONIO HAIL ATTORNEYS
A legitimate roofing contractor should provide a free inspection and provide a bid in writing that itemizes all the proposed work that is necessary. They should also provide photographs of the damage prior to the work being performed. Also, the roofing contractor should be willing to meet with your insurance adjuster and provide the adjuster with details regarding the necessary recommended repairs. The roofing contractor that you choose should be insured and bonded and they should be able to provide you with proof of insurance. Make sure that you are not a victim of predator roofing contractors. Contact one of our experienced hail attorneys today for free advice and consultation.

Question: My home’s roof was damaged in a recent San Antonio hailstorm and I was wondering if I can start making repairs before any further damage occurs?

The typical home insurance policy requires you to mitigate your damages. This is a fancy way to say you are suppose to take minimal measures to prevent additional damage to your home after it has been damaged in a hail storm. A good example is if your roof has gaping holes or missing shingles due to large hail stones and water is leaking inside your home, next place a tarp or some other barrier like plywood over the holes to prevent additional water damage. It is also a good idea to keep any receipts of purchases you make when mitigating your damages so that you can provide those to your insurance carrier for reimbursement. The same advice applies to when you hire a contractor to make repairs, keep those invoices and receipts for your file. Also, always take pictures and/or video of all the damage before any repairs have been made so that you can provide those to your insurance company.

Question: Can I file a hailstorm claim with my home insurance company?

This is another one of the MOST FREQUENT QUESTIONS ASKED TO OUR SAN ANTONIO HAIL ATTORNEYS and the answer is Yes! You should file a hail claim with your home insurance company as soon as possible after a hail storm. Call you insurance company and request an inspection as soon as possible and notify them you will be making a hail claim. Get the hail claim process rolling as soon as you can without any delay so that the insurance company cannot make any excuses not to pay you. If you believe that your insurance company is operating under bad faith and delaying paying your claim or low balling you with an offer that does not even come close to the amount of money needed to repair your home, contact me, an experienced San Antonio hail claim attorney immediately for help.

Million Dollar Hail Lawsuit Verdict

In a Law360, Houston article dated February 13, 2017, a Million Dollar Hail Lawsuit Verdict was reported to have come out of Hidalgo County against insurance mogul USAA. Specifically the article stated the following:

“A Texas jury has sided with a homeowner in his dispute with insurer USAA Texas Lloyd's Co. over a 2012 hail damage claim, finding that the company acted with malice in handling the $76,500 claim and slapping it with a nearly $1.8 million verdict. John R. Griffith, who owns a home in Hidalgo County, filed his fraud and breach of contract lawsuit in April 2014 against USAA and claim adjuster AllCat Claims Service LP, alleging that the companies underpaid him for the damage to his home and other property following a hailstorm on April 20, 2012. The jury found in favor of Griffith, returning its verdict Feb. 7 that included $800,000 in exemplary damages against USAA, which it found had acted with malice in the case. Thomas Sanders of Dykema Cox Smith, who represents USAA and AllCat, told Law360 on Monday that an appeal will be forthcoming in the case. According to the petition, the hail storm damaged Griffith's roof, pool, pool deck, fence and satellite dish. The roof damage caused subsequent damage to the home's ceilings, walls, insulation and flooring. He filed a claim with USAA, and about a month later, in May 2012, AllCat conducted a “substandard inspection” of Griffith's property, he said. During the inspection, Griffith told the court, AllCat spent one hour on site and didn't get on the roof to investigate the extent of damage there, and the report submitted by the AllCat inspectors didn't include all the damage incurred to the property. The damages that were listed in the report were “grossly undervalued,” the petition alleged. “Plaintiff’s experience is not an isolated case. The acts and omissions USAA committed in this case, or similar acts and omissions, occur with such frequency that they constitute a general business practice of USAA with regard to handling these types of claims,” Griffith told the court in his petition. “USAA's entire process is unfairly designed to reach favorable outcomes for the company at the expense of the policyholders.” Neither USAA nor AllCat explained to Griffith why their settlement offer failed to cover the amount of damages, he alleged, telling the court that the companies “knowingly or recklessly made false representations.” The jury found that USAA failed to comply with the insurance policy and that Griffith was owed $76,500 for property damage. The panel awarded Griffith another $76,500 for damages caused by USAA and AllCat's “unfair or deceptive” acts in handling the claim. Because USAA's conduct was “committed knowingly,” the jury also awarded Griffith $335,000, and it required AllCat to award Griffith $200,000 for its knowingly committed conduct. The jury also awarded Griffith $114,000 in attorneys' fees for the trial work, with an additional $85,000 should the case proceed on appeals through the Texas Supreme Court. The jury also found that USAA had committed fraud, awarding Griffith $109,500 for that, and held that there was “clear and convincing evidence” that its malicious acts harmed Griffith. Counsel for Griffith did not immediately return calls seeking comment Monday.

Griffith is represented by Greg Cox of The Mostyn Law Firm. USAA is represented by Thomas Sanders of Dykema Cox Smith. The case is John R. Griffith v. USAA Texas Lloyd's Company et al., case number c-4459-14-d, in Hidalgo County District Court.”

This article addresses some of the more Common Hail Questions associated with hail and hail storms.

Why does it hail when there is a tornado?

Wind, lightning, rain, and hail characteristics vary from each storm, from one minute to the next, and with the direction the storm is moving in relation to the person observing the storm. Hail can indicate the presence of a very dangerous thunderstorm and hail often occurs before a tornado, but not always.

What causes hail?

Hailstones are large, layered ice particles, often round in shape, which are produced by thunderstorms having strong and tilted updrafts. Hailstorms form within an unusually unstable air mass. An unstable air mass is an air mass wherein the temperature drop off with height is much greater than normal.

What’s hailstorm?

Any thunderstorm that produces hail that reaches the ground is referred to as a hailstorm. Hail may have a diameter of 5 millimeters (0.20 in) or more. Hailstones can grow as large as 15 centimeters (6 in) and weigh more than 0.5 kilograms (1.1 pounds). Unlike ice pellets, hailstones are layered and can be irregular as well as clumped together.

How do hailstones get to be so large?

Rain droplets form as the air cools and as the air rises. In the clouds, temperatures drop below freezing and above that is where hailstones forms. The hailstones then grow larger and larger as they move up and down in the thunderstorm updraft. Eventually, the hailstones get so large that they fall to the ground or get blown out of the clouds updraft.

What season does hail typically occur?

Hailstorms can occur during the spring, summer or fall months. The majority of hailstorms occur between May and September. The city of Cheyenne, Wyoming, experiences more hailstorms than any other city in the united States, with upwards of 10 hailstorms per year.

Why does it hail in the summer?

Hailstorms form when strong currents of rising air, known as updrafts, carry droplets of water high enough into the air so that they freeze. A strong cold updraft allows hailstones to grow big enough to reach the ground.

How long do hailstorms typically last?

Hailstorms usually do not last very long, only 5 to 10 minutes on average. But, hailstorms can cause a lot of damage in that short period of time. In addition to damage caused to people’s roofs and siding, hail commonly damages automobiles, airplanes, skylights, gardens and farmer’s crops.

Denying hail claims should not be an insurance business practice. Your hail claim deserves to be evaluated and settled on its merits. Talk to a hail lawyer about your property insurance claim at 1-888-724-HAIL (4245) or contact us online. We offer a free consultation and handle bad faith lawsuits on a contingency fee basis, meaning you do not pay us anything unless we win your hail case.

Some of the more common reasons people wait to file a hail damage claim with their insurance company is that they are worried that it will adversely affect their home insurance rates, they are confused about who is responsible for filing the hail damage claim, they think it might be cheaper just to do the repairs themselves verses making an insurance claim, or they just do not understand the hail claim process. Do not wait too long to file a hail claim because there are Time Limits to File a Hail Insurance Claim and if you miss a deadline, it could adversely impact your ability to make a hail damage claim.

Texas state laws affect how long you have to file a hail damage claim as well as what is stated in your actual home insurance policy. Typically, San Antonio homeowners have one year to file a hail claim from the date of the specific storm, but this can vary significantly from one policy to another. The big misconception is that there is only one deadline to concern yourself with, such as the one year deadline to file a claim contained in most insurance policies. There is not just one deadline involved in handling your hail damage claim, but rather several important deadlines to consider. For example, the time in which you have to notify your insurance company of the hail damage loss. Most insurance policies state that you need to notify the insurance carrier promptly. What does “promptly” actually mean? Typically, if you wait too long and it prejudices the insurance company, then you were not prompt enough. A good rule of thumb is to notify your insurance company as soon as you become aware of a hail damage loss.

Other important deadlines to consider when dealing with a hail damage insurance claim are the many deadlines in which to file the correct claim process forms such as hail loss lists and estimates of repair. These deadlines are often explained to you by the insurance adjuster you are working with.

Also, in addition to the many deadlines to consider regarding your hail claim, you must remember to mitigate further loss to your home as you wait for a response from your home insurance company. You are responsible for doing what you can to prevent further loss to your property, which may include making temporary repairs to avoid additional damage to your home. For example, placing a tarp over holes in your windows and roof to prevent interior water damage.

If you do miss a deadline when dealing with your hail damage claim, you may not be out of luck because generally, an insurance company cannot refuse to pay your hail claim just because you missed a deadline or made a mistake filling out a claim process form. In order for an insurance company to do this, they must show that your missing a deadline caused the insurance company harm or prevented them from properly investigating your hail damage claim adequately. Taking this discussion a step further, you need to know that it may be possible to reopen a hail claim that has been closed or even add to an existing hail claim loss. Of course, there is a time frame in which you have to add a claim of loss that you may have initially overlooked. Also, you may be able to reopen a previously denied hail claim if you think the hail claim was underpaid or unfairly denied.

If your insurance company is not paying you the full amount of your hail or roof damage claim or has denied your claim, please contact us today 1-888-724-HAIL (4245). We have experience dealing with insurance companies, and we would love to help you get the money you deserve.

Hail damage causes major damage to homes, businesses, cars, crops and other property every year. Hail storms and their related damage are more common today in the United States than it used to be and scientist and meteorologist do not know why. Storms that cause hail damage are becoming more and more frequent. The hail storms are striking with more intensity. And, the hail storms are causing greater amounts of damage to homes. As a result, hail damage repairs are costing Texas homeowners and companies more money each year. According to the National Insurance Crime Bureau, the number of hail damage insurance claims filed between 2010 and 2012 in the U.S. has increased eighty-four percent to approximately two million hail claims. Three particular states, Missouri, Kansas, and Texas saw the largest amount of hail damage claims filed over the last three years, with Texas residents filing over 300,000 hail claims. If you believe that your home insurance company is denying your hail claim or underpaying your hail claim, and you need San Antonio Hail Damage Legal Help, contact us today at 1-888-724-HAIL (4245) so we can discuss your legal rights.

Due to the huge increase in hail damage claims, some home insurance companies have responded in an effort to save money. For example, some home insurance companies have taken hail damage out of the list of “covered events” under the standard Texas property insurance policy. Some insurance companies have responded this way because when many homeowners and businesses who are affected by hail go and file hail damage claims all at once, then the home insurance companies must come up with the cash money all at once as well. This large cash demand on insurance companies puts a very large strain on them and can even put them out of business. This potential scenario is not only detrimental to home insurance companies, but it is also detrimental to homeowners too because they will not get their hail claims covered due to the insurance company’s failure.

Another response insurance companies have come up with to combat the issue of increased hail damage claims without substantially raising the price of the standard homeowners’ insurance policy, is to offer separate extended coverage policies that will cover hail damage. By offering a separate extended policy to cover hail damage, the insurance company gives homeowners and businesses the option to pay extra to ensure that hail damage will be covered. As a result, not every homeowner or business will choose to purchase the additional hail coverage, so then the insurance companies will not be hit as hard when a hail storm causes extensive damage to many businesses and homes. Also, the extra hail coverage policy generates extra capital for the insurance company, which can then be used to cover hail claims filed by those homeowners and businesses that paid for the additional hail coverage.

However, there are some drawbacks in offering separate hail coverage policies to businesses and homeowners, the obvious drawback being that it is more expensive for a homeowner or a business owner to protect themselves and cover all of the possible weather events, including hail damage. So, if the home or business owner chooses to roll the dice and not purchase the extended hail damage coverage, the owners run the risk of having to pay all the hail damage expenses out of pocket and this can ruin bankrupt a business or a homeowner.

Hail damage to your home can be costly, especially if your home insurance company claims your policy does not cover the hail damage. If you believe your insurance company has wrongfully denied your claim or offered an unacceptable payout, please contact us today at 1-888-724-HAIL (4245) for San Antonio Hail Damage Legal Help.
