The Trump administration’s Department of Housing and Urban Development (HUD) is investigating whether Wells Fargo violated federal fair-lending laws by using race as a factor in determining who could receive certain mortgage assistance or refinancing benefits.

The investigation announced October 7, 2026 is centered on Wells Fargo’s programs intended to increase Black homeownership.

In 2017, Wells Fargo pledged $60 billion in mortgage lending with the goal of helping create at least 250,000 new Black homeowners by 2027. In 2022, Wells Fargo created a roughly $210 million initiative, including money intended to help eligible Black homeowners reduce mortgage interest rates and refinancing costs.

The programs were explicitly connected by Wells Fargo to the racial homeownership gap and what the bank described as systemic barriers to Black homeownership.

HUD now argues that Wells Fargo may have been “sorting” homeowners by race and providing different products or terms based on racial identity.

The Trump administration has m taken a different regulatory position toward corporate DEI and race-conscious programs. HUD is now examining whether programs that previously operated under a racial-equity framework crossed the line established by the Fair Housing Act.

HUD Secretary Scott Turner has made the administration’s position explicit: even if Wells Fargo ultimately did not violate the law, he objects to financial institutions making lending decisions based on race. HUD says it is also examining similar initiatives at other banks.
