An update on the Texas h**p legal situation. The state filed an appeal against the temporary injunction that had been blocking the smokeable h**p ban, which briefly put the ban back into effect. Following an emergency motion by h**p industry attorneys, the 15th Court of Appeals reinstated the pause on the ban, but only temporarily.

The injunction is currently in place until at least May 14, 2026, which is the deadline for the state to respond to the appeal. After that, the appeals court will determine whether the pause continues while the case moves forward. The district court trial is still scheduled for July 27.

In a separate but related development, the Texas Supreme Court upheld the state's ban on Delta-8 THC, giving DSHS broad regulatory authority - a ruling that could have implications for the broader smokeable h**p fight.
