A federal judge in Texas has struck down FinCEN's Residential Real Estate Reporting Rule - just 19 days after it took effect.

On March 19, U.S. District Judge Jeremy Kernodle ruled that FinCEN exceeded its authority under the Bank Secrecy Act by treating all non-financed residential real estate transactions as categorically suspicious. The ruling vacates the rule nationwide.

FinCEN has confirmed on its website that reporting persons are not currently required to file real estate reports and are not subject to liability while the order remains in force.

What this means right now:
Some major title companies have already paused compliance. Others are continuing to collect data as a precaution. The American Land Title Association (ALTA) recommends the cautious approach: continue collecting information as if reporting will be required - because an appeal is expected, and if the ruling is stayed, the rule snaps back into effect.
