If I use your services, will you be able to put my ex in jail for not paying?

Answer:

We have many collection tools at our disposal, and our main goal is negotiating a steady payment of child support into your household. When someone is incarcerated, they are not likely to be able to pay. We do not find seeking incarceration to be an effective strategy for meeting our goals.

If your ex is in violation of state law because of child support delinquency, he or she is subject to what ever penalties the state deems appropriate, which in many states does include warrants being issued and incarceration.

Do you collect all the money at one time? I'm owed more than $35k!

Answer:

We will pursue whatever avenue of collection will be most beneficial in any given case. In some circumstances, the non-custodial parent has the means to pay a lump sum to satisfy the child support debt. In others, a garnishment for the court ordered amount is what we will be able to collect.

Because the pathways to collection are varied, if you do apply for our services, it is very important to include information about the non-custodial parent's financial situation. Details such as employment history, any settlements received, recent inheritances, or any other financial insight will help us customize our collection strategy.

Today's question:

I have not had contact with my ex for a long time and am not even sure of a current address. If I work with Supportkids and you find the non-custodial parent, will you give me the contact information that you find? I would like to have that information.

Answer:

If our locate efforts on your behalf are successful and we obtain current contact information, we will use it exclusively to initiate child support payments for you. We do not share contact information with either party. Your information remains private, as does the non-custodial parent's information.

If you have something that needs to be relayed to the other parent, such as a letter from a child or other correspondence, we can facilitate.

I am having a child with my new partner. Will the child support amount that I pay to my ex for our two kids change? I won’t have as much money with a new baby arriving soon.

Answer:

In order to make any changes to the child support you are court ordered to pay, you will need to petition the court for a modification. The court will review your income and take in to account any changes in your living situation, such as the addition of a new child.

Please note that if your income has gone up since the last time your court order was reviewed or modified, there may be minimal change to the monthly amount already ordered.

My child support is being taken directly out of my check. I would prefer that my employer not have access to information about the child support payments I am ordered to pay. How can I change this?

Answer:

Wage garnishment is a very effective tool that the state relies on to ensure ongoing and consistent payments from non-custodial parents with steady employment. It is unlikely that they would make an exception, even for someone who has a great track record for on-time payments.

If you have the means or are near the end of your child support obligation, the custodial parent may agree to a settlement wherein the remaining child support amount is paid in full in advance. If you pursue this option, we recommend you retain the services of a family attorney.

My ex has the kids for about 3 weeks total over the holidays. He says he is not going to pay me the full amount for child support, since he has them for so long. Can he do that?

Answer:

Unless your court order specifically calls for a reduction in payment for this type of situation, the full monthly amount of child support is owed as usual. We do not see many court orders that change the amount based on length of visitation over the holidays or summer.

If I sign up with Supportkids, how do I get the money when it is collected? Do you send a check?

Answer:

We have a couple of options for getting you the money we collect on your behalf.

We recommend that you submit your bank information on our secure website so we can deposit your money directly into your bank account.

If that is not an option for you, we will send your payments via a TotalPay Visa card. TotalPay cards are accepted at millions of locations nationwide that accept Visa debit cards. Once your child support payments are loaded onto a TotalPay Card they will be ready for use immediately. If you opt for a TotalPay card, you will receive full instructions on how to use it, including how to obtain cash from it without incurring any fees.

We are taking care of our granddaughter because her parents are not able to right now. Can we try to get child support?

Answer:

If you have a court order that designates you as the guardian of your granddaughter, you can file for child support through your local child support office.

If there are no court documents that make your custody official in legal terms, then you would need to initiate that process first. We recommend seeking a family attorney to help guide you through this process. If that is not an option from a budget stand-point, you can contact the family court in your county so they can assist.

Today's question:

I am getting child support payments right now because they are being garnished and sent to me automatically. My ex is about to retire and I am worried that I won’t get anymore payments once the wage garnishment stops. What should I do?

Answer:

If your ex is old enough to collect social security, those payments can be garnished, just like a wage garnishment. If you are working with a company like Supportkids, or have a family attorney, they can help you with the transition between a wage garnishment and social security garnishment. Otherwise, we recommend you contact the child support enforcement agency in your state and let them know that the change is coming. We also recommend following up with them once the retirement has taken place to make sure everything is in order.
