Form 5106, the Importer ID Input Record, controls where ACE sends your verification codes, and a stale contact means those codes vanish.

The Horse Act of 1884 was not on Frost Law's bingo card last month but that is where IRS Office of Professional Responsibility Director Tom Curtin began his presentation to our attorneys, Enrolled Agents, and CPAs. Congress needed Treasury’s help to police the agents filing Civil War horse claims, and the resulting statute still governs practice before the IRS today. Three points from Director Curtin worth passing along for those that practice:

1. Due diligence under § 10.22 is where the major violations live. Reliance on a client or another professional has to be reasonable. Willful blindness is not reliance.

2. The practitioner's own tax compliance record is part of the agency's file. OPR checks a practitioner’s tax filing and payment history as a matter of course, and persistent nonfiling can support an expedited suspension under § 10.82.

3. OPR is a relatively small office. Keep in mind a formal inquiry from OPR is an investigation, not a verdict. Practitioners get to see the allegations, bring counsel, submit evidence, and confer. Hostility towards IRS employees helps none of that, and contemptuous conduct is itself on the § 10.51 list.

The OPR standards are demanding, but they are not mysterious. Thanks to Director Curtin for making the trip to our office and sharing this important information.

Frost Law attorneys Heather Posey and Darius Liely were featured in CPA Practice Advisor on a Fourth Circuit decision every foreign account holder should know about. In United States v. Rund, a taxpayer who failed to report more than a dozen foreign accounts faced a civil penalty of nearly $3 million, and the court found the violations willful as a matter of law.

The lesson: In Maryland, Virginia, West Virginia, North Carolina, and South Carolina, the IRS does not need to prove intent to conceal. Reckless disregard of the FBAR requirement is enough to trigger a penalty of up to 50% of the account balance, per account, per year.

Frost Law Founding Partner Glen Frost spoke with The Daily Record about how Maryland attorneys are using AI in their practices. The article notes that 69% of U.S. legal professionals now use general-purpose AI tools for work, more than double the share from a year earlier.

He shared that Frost Law uses Claude Enterprise alongside AI tools built into Lexis and Bloomberg Tax. The approach has improved efficiency across administrative functions and helps attorneys stay current on new legislation, agency guidance, and court decisions. The firm has also established an internal Legal Innovation Committee to evaluate emerging technologies and provides ongoing AI training for attorneys and staff.

Like every attorney interviewed for the article, Glen Frost emphasized that AI output still requires careful human review.
