How does a background check work, and is it GDPR-compliant?

Here’s the quick version:
Consent comes first. The candidate understands the process and agrees to every area being checked.
The employer picks the scope: education, employment, references, certifications, criminal records and more.
Every claim is compared with what can be verified, and the source is noted.
Within 5 to 10 days, the employer gets a report flagging each finding as confirmed, minor mismatch or major mismatch.

Why bother? In a 2020 Checkster survey, 78% of job seekers said they’d misrepresented themselves on an application, or had thought about it. The most common: claiming skills they rarely use, and stretching employment dates.

The goal is simple: verify what’s relevant to the role and identify genuine risks. Nothing more.
So what can actually be checked?
🔻 Employment and education history
🔻 Professional licences
🔻 References
🔻 Criminal records, where relevant and legally justified

And what’s off-limits?
❌ Protected characteristics such as religion, ethnicity, age or health
❌ Medical information
❌ Legally spent convictions

For HR teams, relevance matters. Collecting information you don’t need can create unnecessary risk.

64.2% of employees admit to lying on their CV, so checking makes sense. But automatically rejecting anyone with a record can filter out good candidates and expose the company to legal risk.
The better approach is to look at the offence, how long ago it happened and whether it's relevant to the role.

Here's the short version:
Most single checks clear in 1 to 3 working days. A full screening package usually runs somewhere between 2 and 10, depending on what's in it and where your candidate has lived and worked. The slow part is almost always the verifications, employment, education, and references, because those wait on someone else to reply.

A few things that surprise people:
